وفاة الزوجة المتهمة بالزنا قبل الحكم عليها يترتب عليه سقوط الدعوى العمومية بالنسبة لها ولشريكها، وتسقط الدعوى المدنية أيضا تبعا للدعوى الجنائية.

TRIBUNAL OF ASSIUT. (Judgment on Appeal.) 4 DECEMBER 1919. MM. Muhammad Hamdy Bey (Pres.); Mahmud Hilmy Soukah Effendi, Muhammad Tewfik Ibrahim Effendi (JJ.); Mahmud El Sayed Effendi (State Rep.). STATE REPRESENTATIVE AND ANOTHER v. AISHA OSMAN AND ANOTHER. Adultery of wife—Death—Effect on public action and civil action. (Arts. 235, 236 P.C.) The death of the wife accused of adultery, where it occurs before judgment is given in the case, extinguishes the public action as against the wife's accomplice as well. As a result of such extinction, the civil action is also extinguished.

MINISTÈRE PUBLIC ET AUTRE contre AICHA OSMAN ET AUTRE. Adultère de la femme—Décès—Effet sur l'action publique et l'action civile. (Art. 235, 236 C.P.) Le décès d'une femme prévenue d'adultère, survenu avant le jugement, éteint l'action publique tant à son égard qu'à l'égard du complice. L'action civile s'éteint aussi par voie de conséquence.
