المبادئ المستخلصة
(١) للمستأنف عليه الحق فى رفع استئناف فرعى عن الحكم الصادر ضده ما دامت المرافعة قائمة أمام محكمة الاستئناف ولم يترك المستأنف الأصلى دعواه، وذلك بالرغم من انتهاء ميعاد الاستئناف بالنسبة له أو قبوله الحكم. (٢) اذا كان الحكم شاملا لعدة نقط ورفع أحد الخصوم استئنافا أصليا عن أحدها جاز للمستأنف عليه أن يستأنف الحكم استئنافا فرعيا ليس فقط بالنسبة للنقطة التى اشتمل عليها الاستئناف الأصلى بل بالنسبة للنقط جميعها. (٣) اذا ذكر فى مخالصة أن المؤجر يحتفظ لنفسه بالحق فى المطالبة بأجرة خاصة بمدة سابقة فلا يكفى هذا التحفظ لقطع سريان المدة اللازمة لسقوط حقه فى تلك الأجرة. (٤) يجوز للمستأجر الذى اعترف بعدم دفع الأجرة المطلوبة أن يتمسك بسقوطها بمضى الخمس السنوات المنصوص عليها بالمادة ٢١١ مدنى اذا لم يمكن أن يستنتج من اعترافه ومن ظروف الدعوى أنه انما قصد التنازل عن سقوط الحق الذى اكتسبه بمضى المدة.

A respondent has, up to the moment when the appeal is abandoned or when pleadings are terminated, the right to lodge an incidental appeal from the judgment given against him, nothwithstanding his previous acquiescence therein or the expiration of the time-limit fixed for lodging a principal appeal. II. Where a judgment contains several distinct heads and a party makes appeal as regards one of such heads, the respondent may lodge an incidental appeal not only as regards the subject-matter of the principal appeal, but also as regards all the other heads which were not included therein.(1) III. The statement, in a receipt for rent, that the lessor intends to claim later the rent due for a previous period, is not sufficient to interrupt the extinctive prescription relating thereto. IV. The quinquennial prescription provided for by Article 211 C.C. may be invoked by a tenant who has admitted that he had not paid the rent claimed, if it does not result from his admission and from the circumstances of the case that he intended to renounce the benefit of the prescription already acquired.(2) (1) See, DALLOZ, C.P.C.C. II. Lorsqu'un jugement contient plusieurs chefs distincts et qu'une des parties interjette appel de l'un d'eux, l'intimé peut appeler incidemment non seulement de ce chef, mais encore de ceux dont il n'y a pas eu appel principal.(1) III. La mention dans une quittance de loyers que le bailleur se réserve de réclamer les loyers d'une période antérieure, ne suffit pas pour interrompre la prescription libératoire des loyers y relatifs. IV.
