المبادئ المستخلصة
(١) يفقد المالك الذى نزع ملكه للمنفعة العامة بمجرد نزع ملكيته كل حق على العين التى أخذت منه، فليس له أن يتمسك بحق الأولوية على غيره من المشترين اذا عرضت الادارة العين للبيع بعد ذلك، لكن يجوز له أن يشفع فيها اذا كان موقع أملاكه الأخرى يسوغ له استعمال حق الشفعة. (٢) ان نزع الملكية للمنفعة العامة لا يترتب عليه حتما أن كل عقار نزعت ملكيته لهذا الغرض يصبح من أملاك الحكومة العامة، إنما تتعين طبيعته بالنظر الى الغاية التى كان مخصصا لها؛ فاذا نزعت ملكية أرض طبقا للمادة الثالثة من القانون رقم ٥ لسنة ١٩٠٧ لأجل تسهيل الأعمال اللازمة لتوسيع احدى محطات السكة الحديدية ولم تكن هذه الأرض داخلة فى الأرض المخصصة فعلا لتوسيع المحطة بقيت خارجة عن أملاك الحكومة العامة وجاز للادارة بيعها بدون ضرورة الى استصدار مرسوم لذلك. (٣) لا تسرى المادة ٢٩ من لائحة ترتيب المحاكم الأهلية القاضية بتطبيق قواعد العدل إلا اذا كانت نصوص القانون غير واضحة.

Expropriation for purposes of public utility—Immovable expropriated—Sale by administration—Position of the expropriated owner. II. Expropriation for purposes of public utility—Property expropriated—Public and private domain of the State—Railway station—Enlargement—Neighbouring immovable. III. Law—Application—Rules of equity. (I. Art. 88 C.C.—Law No. 5 of 1907 as to Expropriation for purposes of public utility.—II. Law No. 5 of 1907, Art. 3—III. Art. 29, Org. Decree.) I. The owner of an immovable expropriated for purposes of public utility loses, by the expropriation thereof, every right in such immovable. In particular, he cannot claim to have any right of preference in case the expropriated property is subsequently offered for sale by the Administration, but he may exercise his right of pre-emption if the situation of his other properties authorizes him to do so. II. Property expropriated for purposes of public utility does not necessarily become part of the public domain of the State. Its legal character will be determined by the purpose to which it is devoted. Thus, where a plot of land was expropriated in conformity with Article 3 of Law No. 5 of 1907, in order to facilitate the enlargement of a railway station, but was not included in the land actually affected for the enlargement, such plot does not form part of the public domain of the State and may be sold without a decree of declassification. III. Article 29 of the Organic Decree of the Native Courts, prescribing the application of the rules of equity, comes into effect only when the provisions of the law are not explicit.

Le propriétaire d'un immeuble exproprié pour cause d'utilité publique, perd, par l'effet de l'expropriation, tout droit sur le dit immeuble. Notamment, il ne peut prétendre à aucun droit de préférence dans le cas où le bien serait plus tard mis en vente par l'administration, sauf son droit de préemption si la situation de ses biens lui en permet l'exercice. II. Tout bien exproprié pour cause d'utilité publique ne tombe pas fatalement dans le Domaine public de l'Etat. Sa nature sera déterminée par la destination qui lui sera donnée. Ainsi, ne fait pas partie du Domaine public de l'Etat, et peut être vendue sans décret de désaffectation, la parcelle de terrain expropriée conformément à l'article 3 de la Loi n° 5 de 1907, pour mieux permettre de procéder à l'agrandissement d'une gare, lorsque la parcelle n'est pas comprise dans le terrain même affecté à l'agrandissement. III. L'article 29 du Décret de Réorganisation des Tribunaux Indigènes, qui prescrit l'application des règles de l'équité, ne s'applique que dans le cas où les dispositions de la loi ne sont pas claires.
