المبادئ المستخلصة
ليس من اختصاص المجلس الحسبى تعيين وصى بالخصومة لمقاضاة ولى القاصر الشرعى وانما هذا من اختصاص المحاكم الشرعية دون غيرها. أما اذا كان المقصود من تعيين الوصى بالخصومة مقاضاة وصى أو قيم معين من قبل المجلس الحسبى فيكون هذا المجلس مختصا بذلك.

DAME SADDIKA AND OTHERS. Meglis Hasby—Competence—Tutor ad litem—Appointment—Mehkemeh Sharia. (M.O. of the Ministry of the Interior of January 26, 1897, Art. 16, concerning Meglis Hasbys.) The Meglis Hasby has no jurisdiction to appoint a tutor ad litem with a view to his suing the legal tutor (wali) of a minor. Such an appointment lies within the exclusive competence of the Mehkemeh Sharia. Where, however, it is necessary to sue a tutor or a curator who has been appointed by a Meglis Hasby, the Meglis Hasby is competent to appoint a tutor ad litem.

LE MINISTRE DE LA JUSTICE contre DAME SADDIKA ET AUTRES. Méglis Hasby—Compétence—Tuteur ad litem—Nomination—Mehkémeh Charieh. (Arr. Min. de l'Int. du 26 janv. 1897, Art. 16, sur les Méglis Hasby.) Le Méglis Hasby n'est pas compétent pour nommer un tuteur ad litem à l'effet de poursuivre en justice le tuteur légal (wali) sous la puissance duquel se trouve le mineur. Pareille nomination est de la compétence exclusive du Mehkémeh Charieh. Toutefois, s'il s'agit de poursuivre un tuteur ou un curateur nommé par le Méglis Hasby, c'est ce dernier qui devient compétent pour désigner le tuteur ad litem.
