المبادئ المستخلصة
اذا عقد عدّة أشخاص اتفاقا أو ألفوا شركة محاصة بقصد الحصول على ايجار أرض بطريق المزايدة واشترطوا أن من يرسو عليه المزاد يتنازل لشركائه عن أنصبتهم فيه أو يدفع لهم مبلغا معينا بصفة شرط جزائى اذا آثر الانتفاع بالمزاد وحده فلا يعدّ عملهم هذا مخالفا للقانون . نص الحكم على المجلد الثالث والثلاثين من موسوعات دللوز صفحة ١٦٩ نمرة ٥٨١ والمجلد الثالث والأربعين نمرة ٢٢٢٧ .

COURT OF APPEAL. 2 February 1920. MM. Percival (Pres.); Mustafa Fathy Bey, Yussef Soliman Bey (JJ.). ALY BEY SOLIMAN v. SHEIKH SALEH MUHAMMAD KANDIL AND ANOTHER. Adjudication—Association formed in view of obtaining an adjudication—Lawfulness of agreement. (Art. 95 C.C.) An agreement made, or an association in participation formed, between several persons in view of obtaining the adjudication of a lease of land cannot be regarded as unlawful, whether it was agreed that the adjudicatee would cede back to the others such share as they are entitled to, or that, if he kept the whole of the land leased to him, he would pay a certain sum of money as damages under a penal clause. Adjudication—Association en vue d'obtenir une adjudication—Caractère licite de la convention. (Art. 95 C.C.) On ne pourrait regarder comme illicite la convention ou association en participation formée entre plusieurs individus en vue d'obtenir la location d'une terre mise en adjudication, soit sous la condition que l'adjudicataire rétrocèdera aux autres la part qui leur revient, soit sous la condition que s'il garde l'exploitation pour lui seul, il paiera une certaine somme à titre de clause pénale.
