المبادئ المستخلصة
(١) لا يشترط لأجل اثبات صحة السند بشهادة الشهود أن تكون تمت عملية المضاهاة بواسطة خبراء وللقاضى تمام الحرية فى اجراء التحقيق بنفسه بواسطة المستندات الموجودة فى ملف الدعوى أو الاستعانة بأهل الخبرة فى ذلك أو الالتجاء الى أية طريقة أخرى من طرق التحقيق (١) . (٢) اذا أنكر المدعى عليه فى مسألة تحقيق الخطوط أوراق المضاهاة التى قدّمت له فتنازل المدعى عن عملية المضاهاة كان له رغم تنازله هذا أن يعمد الى وسيلة أخرى لاثبات صحة الورقة . (٣) للقاضى اذا قام نزاع بشأن صحة ورقة الحرية التامة فى أن يستخلص من ظروف الدعوى قرائن كافية تجعله يعتقد بأن الورقة صحيحة بدون أن يأمر بتحقيق الخطوط (٢) . وله على الأخص أن يستخلص الأدلة اللازمة من المستندات المودعة فى ملف الدعوى حتى ولو كانت غير مستوفية للشرائط التى تتطلبها المادة ٢٦١ من قانون المرافعات لقبولها كأوراق مضاهاة . Evidence in civil cases — Documents — Genuineness denied—Power of judge. II. Verification of documents — Comparison—Documents objected to—Abandonment by plaintiff—Effects. III. Evidence in civil cases — Proof by writing — Document denied — Power of judge. I. It is not necessary in order to establish by witnesses the genuineness of a document, that experts should have previously proceeded to a verification of the document by way of comparison. The judge has always the power to proceed to effect the verification himself by making use of the documents produced in the cause, or to have recourse to an enquiry by experts or to any other means of investigation. (1) II. Where the defendant in verification proceedings objects to documents produced for purposes of comparison, and the plaintiff abandons the comparison, the latter may still prove by other means the genuineness of the document denied. III. Where a document is denied, the judge may, in his discretion, draw from the facts and circumstances of the case, sufficient persumptions to convince him of the genuineness of the document, without necessity for ordering the verification of the document. (2) In particular, he may draw the necessary evidence from the documents produced in the case, even though they could not be admitted for purposes of comparison, the conditions required by Article 261 C.C.C.Pr., being wanting. III. Lorsqu'un écrit est contesté, le juge peut, dans son pouvoir discrétionnaire, tirer des faits et des éléments de la cause des présomptions suffisantes pour le convaincre que l'acte est sincère, sans qu'il soit besoin d'ordonner une vérification d'écriture.
