المبادئ المستخلصة
لما كان قانون المجالس الحسبية لم يحتم اتباع طريق مخصوص فى بيع عقار القصر بيعا اختياريا كان للمجالس الحسبية مطلق الحرية فى اختيار الطريق التى تراها أكثر نفعا لهم . وتحقيقا لهذا الغرض يكفى أن تباع هذه العقارات بالمزاد العلنى سواء حصل المزاد أمام هذه المجالس نفسها أو أمام المحاكم الأهلية . قارن حكم محكمة منوف الجزئية ١٨ نوفبر سنة ١٩١٦ (المجموعة الرسمية السنة الثامنة عشر عدد ٦٠) وقرار المجلس الحسبى العالى ١٩ يوليه سنة ١٩١١ (وزير الحقانية ضد سيد أحمد محمد [عمال] . لم ينشر) . راجع فى هذا الموضوع شرح البيع لحلمى عيسى بك نبذة ١٧٣٣ .

MINISTER OF JUSTICE v. ABDEL RAHMAN EFFENDI AZMY. Sale—Sale of immovable property of minors—Public auction. (Art. 13, Decree of Nov. 19, 1896 concerning Meglis Hasbys; Arts. 614-619 C.C.C.Pr.) The law concerning Meglis Hasbys has not prescribed a particular mode of effecting the voluntary sale of immovable property belonging to minors: the Meglis Hasbys are therefore free to proceed to effect such sale in the manner which they deem to be the most advantageous in the interests of the minors. It is sufficient, in order to obtain this object, to sell the property by public auction, whether such auction takes place before the Meglis Hasbys themselves or before the Native Tribunals. MINISTRE DE LA JUSTICE contre ABDEL RAHMAN EFFENDI AZMI. Vente—Vente d'immeubles des mineurs—Enchères publiques. (Art. 13, Décret du 19 nov. 1896 sur les Méglis Hasby—Art. 614-619 C.P.C.C.) La loi sur les Méglis Hasby n'ayant pas imposé un mode spécial pour la vente volontaire des immeubles des mineurs, ces Méglis sont libres de procéder à la vente de la manière qu'ils jugeraient être la plus avantageuse pour les mineurs. Il suffit, pour réaliser ce but, de vendre les immeubles aux enchères publiques, que ces enchères aient lieu devant les Méglis Hasby eux-mêmes ou devant les Tribunaux Indigènes. Comp., Trib. Som.
