المبادئ المستخلصة
إذا تصرف الأب بصفته وليا شرعيا على ابنته القاصرة فى عقار تملكه فلا يكون تصرفه هذا مبررا لطلب توقيع الحجر عليه. والمجلس الحسبى ليس له حق التداخل فيما يتعلق بتصرفات الولى، فإذا نُسب لولى أمور تستوجب عزله وجب رفع الأمر إلى المحكمة الشرعية.

MM. Yahia Ibrahim Pasha (Pres.) ; Ahmad Zulficar Pasha, Hussein Darwish Bey, El Sheikh Hassan El Banna, Abdel Aziz Fahmy Bey (Members.). SALEM MOHAMMAD EL BARADEE v. MOHAMMAD SALEM EL BARADEE. Legal guardian (Wali)—Meglis Hasby—Mehkemeh Sharia—(Art. 16, Meglis Hasby's Regulations of January 26, 1897.) The fact that a father, as legal guardian (wali) of his daughter under age, disposed of property belonging to the latter, does not justify placing him under interdiction. The Meglis Hasby has no power to intervene in regard to a legal guardian's administration of the affairs of his ward. But if there are causes of complaint against such a guardian, which would justify his dismissal, the matter must be brought before the Mehkemeh Sharia. Le fait par un père d'avoir disposé, en sa qualité de tuteur légal (wali), d'un bien appartenant à sa fille mineure, ne justifie pas une demande d'interdiction contre lui. Le Méglis Hasby n'est pas compétent pour intervenir lorsqu'il s'agit de la gestion d'un tuteur légal ; mais s'il existe à sa charge des griefs de nature à le faire révoquer, c'est le Mehkémeh Charieh qui doit en être saisi.
