المبادئ المستخلصة
تقضى المادة ١٦ من لائحة المجالس الحسبية الصادرة فى ٢٦ يناير سنة ١٨٩٧ بعدم تداخل المجلس الحسبى اذا كان للقاصر أو لعديم الأهلية ولى شرعى . وعلى ذلك اذا نسبت للولى الشرعى أمور تستوجب عزله وجب رفع الشكوى الى المحكمة الشرعية فاذا حكمت بعزله أصبح من حق المجلس تعيين وصى .

DAME ZEINAB BENT HAMDOON AND ANOTHER. Legal guardian—Dismissal—Meglis Hasby—Want of jurisdiction—Mehkemeh Sharia.—(Art. 16 of Meglis Hasbys' Regulations of January 26, 1897.) Article 16 of the Meglis Hasbys' Regulations of January 26, 1897, provides that the Meglis Hasby has no power to intervene where a minor or an incapable person is under the authority of a legal guardian (wali). Consequently, where there are causes of complaint against a legal guardian, which would justify his dismissal, the matter must be brought before the Mehkemeh Sharia, and when the guardian has been dismissed by order of the Mehkemeh, the Meglis Hasby can then proceed to appoint another guardian in his place.

MINISTRE DE LA JUSTICE contre DAME ZEINAB BENT HAMDOUN ET AUTRE. Tuteur légal—Révocation—Méglis Hasby—Incompétence—Mehkémeh Charieh.—(Art. 16 du Règlement des Méglis Hasby du 26 janvier 1897.) L'article 16 du Règlement des Méglis Hasby du 26 janvier 1897 dispose que si le mineur ou l'incapable se trouve sous la puissance d'un tuteur légal (wali), il n'y a pas lieu à l'intervention du Méglis Hasby. Par conséquent, s'il existe à la charge d'un tuteur légal des griefs de nature à le faire révoquer, c'est le Mehkémeh Charieh qui doit en être saisi et, une fois le wali révoqué, le Méglis Hasby pourvoira à la nomination d'un autre tuteur.
