المبادئ المستخلصة
ان الحدود التى نصت عليها المادة ٣١٣ عقوبات هى الحدود التى وضعت بين عقارين متجاورين باتفاق مالكيهما أو تنفيذا لحكم صادر من سلطة مختصة . وقد حكم بأنه لا عقاب بمقتضى هذه المادة على مالك أحد العقارين المتجاورين اذ كان قد أتلف حدا وضعه العمدة (قياما بمـا فرضته عليه المـادة ١٠ من الأمر العالى الصادر فى ١٦ مارس سنة ١٨٩٥ من لتوسط بطريقة ودية لفض المنزعات على الحدود) فأزاله ذلك المالك بعد وضعه مباشرة لعدم رضائه بتلك التسوية . أنظر تعليقات داللوز على قانون العقوبات مادة ٤٥٦ نمرة ٧٣ راجع محكمة كفر الزيات الجزئية ٢ مارس سنة ١٩١٥ (المجموعة الرسمية السنة السادسة عشرة عدد ١٠٢) .

Muhammad Mourad Sid Ahmad Bey (Pres.) ; Hussein Sadek Effendi, Abdel Latif Ghorbal Effendi (JJ.); Muhammad Muhammad Korraa Effendi (State Rep.). STATE REPRESENTATIVE v. ABDEL RAHMAN ABDALLAH ZIDAN. Landmarks—Destruction—Elements of the offence.—(Art. 313 P.C.) The landmarks, referred to in Art. 313 P.C., are those which have been set up between two adjoining properties, either under an agreement between their respective owners or in accordance with a decision of the competent authorities. Held, that no offence was committed under the above-mentioned Article where landmarks, set up by the Omdeh acting amicably under Art. 11 of the Decree of March 16, 1895, were there and then destroyed by one of the contiguous owners, who refused to accept the delimitation. MINISTÈRE PUBLIC contre ABDEL RAHMAN ABDALLA ZIDAN. Bornes—Destruction—Eléments de l'infraction.—(Art. 313 C. P.) Les bornes, dont il est question à l'article 313 C.P., sont celles qui sont placées entre deux propriétés contiguës, soit par suite d'un accord entre les propriétaires respectifs, soit en exécution d'une décision des autorités compétentes. Jugé, qu'il n'y a pas d'infraction du chef du dit article, lorsque des bornes, placées par l'omdeh agissant à l'amiable conformément à l'article 11 du Décret du 16 mars 1895, ont été détruites sur le champ par l'un des propriétaires contigus, lequel ne voulait pas reconnaître ce bornage.
