المبادئ المستخلصة
السيد مسؤول عن الأضرار التى تنشأ من أعمال خادمه أثناء تأدية وظيفتـه . وقد حكم بأن مصلحة الصحة العمومية ملزمة بتعويض الضرر المترتب على خطأ ممرض فى خدمتها إذ أراد هــذا الممرض أن يعطى دواء لمريض وُكل اليــه أمر العناية به فأخطأ وأعطاه سمـا كان سببا فى موته . أشار الحكم الى كتاب سوردا فى المسؤولية الجزء الثانى نبذة ٩٠١ .

COURT OF APPEAL. 29 March 1920. MM. Percival (Pres.) ; Mustafa Fathy Bey, Yussef Soliman Bey (JJ.). DEPARTMENT OF PUBLIC HEALTH v. DAME SETT EL BANAT BENT ABDU AND OTHERS. Liability for tort—Master and servant—Public Health Department—Hospital attendant—Error—Damage.—(Art. 152 C.C.) A master is liable for the damage resulting from acts done by his servants in the execution of their duties. Held, that the Public Health Department was liable for damages in respect of an error committed by a hospital attendant in its service, who, instead of giving a medicine to a patient under his care, gave him a poison which caused his death. COUR D'APPEL. 29 Mars 1920. MM. Percival (Prés.); Moustapha Fathi Bey, Youssef Soliman Bey (CC.). ADMINISTRATION DE L'HYGIÈNE PUBLIQUE contre DAME SETT EL BANAT BENT ABDOU ET AUTRES. Responsabilité civile—Maître et serviteur—Administration de l'Hygiène Publique—Infirmier—Erreur—Préjudice.—(Art. 152 C.C.) Le maître est responsable du dommage résultant des actes faits par ses serviteurs dans l'exercice de leurs fonctions. Jugé, que l'Administration de l'Hygiène Publique est responsable des suites de l'erreur d'un de ses infirmiers qui, voulant donner à un malade sous sa garde un remède, lui administre un poison causant ainsi sa mort.
