المبادئ المستخلصة
ان المادة ١٦٦ من قانون تحقيق الجنايات التى نصت على أن الشهود يجب حجزهم فى غرفة خاصة ولا يسمح لهم بالخروج منها إلا بالتوالى لأداء شهادتهم أمام المحكمة لم تقض ببطلان الاجراءات اذا لم يتبع ذلك النص . وعلى ذلك فلا وجه للنقض فى حالة ما اذا سمعت شهادة بعض الشهود فى جلسة الصباح وتركوا أحرارا الى جلسة بعد الظهر هم والشهود الذين لم تكن سمعت شهادتهم فأمكنهم الاختلاط ببعضهم البعض .

COURT OF CASSATION. 24 APRIL 1920. MM. Ahmad Talaat Pasha (Pres.); Marshall, Caloyanni, Mustafa Fathy Bey, Yussef Soliman Bey (JJ.); Aly Salem Bey (State Rep.). SHEHATA MUHAMMAD ALY AND OTHERS v. STATE REPRESENTATIVE AND OTHERS. Cassation—Substantial nullity of the procedure—Room set apart for witnesses.—(Art. 166 C.Cr.Pr.) In providing that witnesses should be put in a room set apart for them, which they may only leave successively in order to give their evidence before the tribunal, Article 166 C.Cr.Pr. does not require this measure to be taken on pain of nullity. Consequently, there is no ground for cassation where witnesses who had given evidence at the morning hearing, and witnesses who had not yet given evidence, were left at liberty until the hearing was resumed in the afternoon, and thus were able to communicate with each other. CHEHATA MOHAMED ALY ET AUTRES contre MINISTÈRE PUBLIC ET AUTRES. Cassation — Nullité substantielle de la procédure—Chambre réservée aux témoins.—(Art. 166 C.I.C.) L'article 166 C.I.C. qui prescrit que les témoins doivent être tenus dans une chambre réservée d'où ils ne doivent sortir que successivement pour faire leur déposition devant le tribunal, n'a pas édicté cette mesure à peine de nullité. Par conséquent, ne donne pas lieu à cassation, le fait que les témoins entendus à une audience du matin et ceux qui n'ont pas encore déposé, ont été laissés en liberté jusqu'à l'audience de l'après-midi et ont pu ainsi communiquer les uns avec les autres.
