المجلس الحسبى مختص بالنظر فيما يطلبه من يريد مقاضاة التركة لدين له عليها من تنصيب وصى للخصومة حتى يمثل القصر فى الدعوى . ولا محل للقول بعدم اختصاص المجلس الحسبى فى ذلك بناء على المادة ٢٩ من القانون نمرة ٣٢ لسنة ١٩١٠ الخاص بالمحاكم الشرعية فانها لا تنطبق إلا على الأمور الداخلة فى اختصاص المحاكم المذكورة .

AGRICULTURAL BANK OF EGYPT. Tutor "ad litem" — Appointment — Competence of Meglis Hasby. The Meglis Hasby is competent to appoint, at the request of a third party interested in a succession, a tutor ad litem for the purpose of representing the minor heirs in litigation. A plea of want of jurisdiction based on Article 29 of Law No. 32 of 1910 concerning Mehkemehs, cannot be entertained, as the provisions of that article refer only to questions falling within the jurisdiction of Mehkemehs. MINISTRE DE LA JUSTICE contre AGRICULTURAL BANK OF EGYPT. Tuteur ad litem — Nomination — Compétence du Méglis Hasby. Le Méglis Hasby est compétent pour nommer à la demande d'un tiers ayant intérêt à assigner une succession en justice, un tuteur ad litem pour y représenter les héritiers mineurs. Nulle incompétence ne saurait être soutenue du chef de l'article 29 de la Loi n° 32 de 1910 sur les Mehkémehs, ce texte ne visant que les matières rentrant dans la juridiction des dits Mehkémehs.
