المبادئ المستخلصة
لا يجوز للمجلس الحسبى أن يضم مشرفا الى الوصى المختار قبل أن يتمكن من تقدير ادارة الوصى لشؤون القاصر . فان المادة السابعة عشرة من لائحة المجالس الحسبية الصادرة فى ٢٦ يناير سنة ١٨٩٧ قد نصت على أن وظيفة المجلس فى مثل هذه الحالة انما هى اجراء التصديق من القاضى على الوصاية التى اختارها المتوفى وذلك بعد استيفاء الاجراءات القانونية .

EL SHEIKH KAMAL EL DAWLA KASSEM. Meglis Hasby — Functions — Testamentary tutor — "Subrogé-tuteur."—(Art. 17, Meglis Hasbys Regulations of January 26, 1897.) A Meglis Hasby is not entitled to appoint a "subrogé-tuteur" (mushrif) in order to control the management of an infant's property by the testamentary tutor (wassi moukhtar), until it has had time to judge of the manner in which the infant's interests were being managed. In fact, Article 17 of the Meglis Hasbys Regulations of January 26, 1897, provides that, in the case of the initial appointment of a testamentary tutor, the functions of the Meglis Hasby simply consist in securing the Cadi's ratification of the appointment made by the deceased, after the necessary legal formalities have been carried out.

MINISTRE DE LA JUSTICE contre CHEIKH KAMAR EL DAWLA KASSEM. Méglis Hasby—Attributions—Tuteur testamentaire—Subrogé-tuteur.—(Art. 17, Règlement des Méglis Hasbys du 26 janvier 1897.) Le Méglis Hasby n'est pas autorisé à joindre au tuteur testamentaire (wassi moukhtar) un subrogé-tuteur (mouchrif), avant d'avoir pu apprécier la manière dont les intérêts du mineur sont gérés. En effet, l'article 17 du Règlement des Méglis Hasbys du 26 janvier 1897 dispose que la mission du Méglis en ce cas se borne "à faire confirmer par le Cadi la nomination faite par le défunt, après les constatations de droit."
