المبادئ المستخلصة
يجب أن يحدد اعلان الاستئناف لحضور المستأنف عليه يوم جلسة والإ كان لاغيا . ولا يكفى أن يكلف المستأنف عليه بالحضور فى يوم معين ليس من أيام الجلسات .

Appeal, civil—Notice of appeal—Contents—Fixation of a sitting day. (Art. 363 C.C.C.Pr.) The notice of appeal must, on pain of nullity, fix a regular day of sitting for the appearance of the respondent. It is not sufficient that it should summon him to appear before the Court at a fixed date which does not correspond to a day on which the Court sits.

Il ne suffit pas qu'il donne assignation pour une date déterminée qui ne coïnciderait pas avec un jour d'audience.
