المبادئ المستخلصة
(١) يعتبر ركن العلانية متوافرا فى جريمة السب وان صدرت عبارات السب فى محل خصوصى كما لو صدرت فى منزل مثلا اذا قيلت تلك العبارات بصوت عال أمكن سماعه من الشارع . (٢) يعاقب على السب العلنى ولو صدر فى غياب الشخص، الموجه اليه السب بشرط أن يكون قد ذكر اسمه أو عين، تعيينا كافيا .

Insults—Elements of offence—Publicity. II. Insults—Elements of offence—Absence of the person insulted. (Art. 118 P.C.) I. Insults are deemed to have been proffered in public where the insulting words, although spoken in a private place such, for example, as a house, were so uttered as to be heard in the street. II. The offence of public insults is punishable even though the insulting words were uttered in the absence of the person insulted, provided that such person has been mentioned by name or otherwise sufficiently designated.

En matière d'injures, il y a publicité lorsque les propos injurieux, même proférés dans un lieu privé, tel, par exemple, qu'une maison, ont été tenus de manière à être entendus de la rue. II. L'injure publique est punissable, même lorsque les propos injurieux ont été tenus en l'absence de la personne injuriée, à condition que cette personne ait été nommée ou suffisamment désignée.
