المبادئ المستخلصة
تختلف الجريمة المنصوص عليها فى المــادة ١٩٠ من قانون العقوبات عن الجريمة الواردة فى المــادة ١٨٩ منــه لأن المــادة ١٩٠ عقوبات تنطبق على كل شهادة طبية مزوّرة أعدّت لتقديمها الى المحاكم بخلاف المادة ١٨٩ فانها لا تنسرى إلا على الشهادات الطبية المقدمة للسلطات الادارية والتى تقرر كذبا وجود أمراض أو عاهات تستوجب الاعفاء من خدمة عمومية .

COURT OF CASSATION. 9 November 1918. MM. Yahia Ibrahim Pasha (Pres.); Abdel Aziz Kahil Pasha, Percival, Mustapha Fathi Bey, Hussein Darwish Bey (JJ.); Rizkalla Simaika Bey (State Rep.). DOCTOR NASHED BASSILI EFFENDI v. STATE REPRESENTATIVE. Falsification—Medical certificates—Certificate given with a view to its production in court. (Arts. 189, 190 P.C.) Article 190 P.C. provides for a different offence from that punishable under Article 189. In fact, while the latter Article is only concerned with medical certificates addressed to the Administrative Authorities and falsely attesting the existence of disease or infirmity of such a nature as to procure exemption from a public duty, Article 190 is applicable to any false certificate delivered by a physician, where it is given with a view to its production in a court of justice.

DOCTEUR NACHED BASSILI EFFENDI contre MINISTÈRE PUBLIC. Faux—Certificats médicaux—Certificats destinés à être produits en justice. (Art. 189, 190 P.C.) L'article 190 C.P. prévoit une infraction différente de celle de l'article 189. En effet, alors que ce dernier Article ne vise que les certificats médicaux adressés aux autorités administratives et attestant faussement des maladies ou infirmités de nature à exempter d'un service public, l'Article 190 s'applique à tout faux certificat délivré par un médecin, si ce certificat est destiné à être produit en justice.
