المبادئ المستخلصة
بيع الأراضى الزراعية لا يشمل ما عليها من الزرع وقت البيع سواء كان ناضجا أو غير ناضج ما لم ينص صراحة أو يجر العرف على خلاف ذلك . غير أنه اذا كان الزرع لم ينضج كان للبائع الخيار فى أن يقلعه قبل تسليم الأرض أو يتركه للمشترى . أنظر حكم محكمة كفر صقر الجزئية فى ٨ يوليه سنة ١٩١٧ (المجموعة الرسمية السنة التاسعة عشرة عدد ٤٥) . قارن مع ذلك شرح دوهلس على القانون المدنى الأهلى جزء رابع نبذة ١٩٤ تحت كلمة بيع .

Sale—Accessories of the thing sold—Sale of land—Crops. (Art. 288 C.C.) In the absence of express agreement or of established usage to the contrary, the sale of agricultural land does not include the crops standing thereon at the moment of the sale, whether such crops are already ripe or not. In the latter case, however, the vendor has to choose between taking them away before delivering the land, or leaving them to the purchaser. See, Sum. Trib. A moins de stipulation expresse ou d'usage établi contraire, la vente d'un terrain de culture ne comprend pas les récoltes qui s'y trouvent au moment de la vente, qu'elles soient arrivées à maturité ou qu'elles soient encore en croissance.
