المحاكم الأهلية مختصة بالفصل فى النزاع القائم بين وقفين بشأن ملكية أراض حولها النيل لأن مثل هــذا النزاع لا مساس له بأصــل الوقف بالمعنى المقصود فى المادة ١٦ من لائحة ترتيب المحاكم الأهلية .

Jurisdiction of Native Tribunals, Restrictions on—Wakf—Land displaced by the Nile—Ownership. (Art. 16 Org. Decree; Art. 61 C.C.) The Native Tribunals have jurisdiction to try a dispute between two wakfs as to the ownership of land displaced by the Nile, because such a dispute is not a dispute concerning the "constitution of a wakf," within the meaning of Article 16 of the Organic Decree of the Native Tribunals.

Compétence des Tribunaux Indigènes, Limites—Wakf—Terrains déplacés par le Nil—Propriété. (Art. 16, Déc. Réorg.: Art. 61 C.C.) Les Tribunaux Indigènes sont compétents pour connaitre d'un litige entre deux wakfs sur la question de la propriété des terrains déplacés par le Nil, pareil litige n'étant pas une "contestation relative à la constitution des wakfs", aux termes de l'article 16 du Décret de Réorganisation des Tribunaux Indigènes.
