المبادئ المستخلصة
ان المادة ٢٤٦ من قانون العقوبات التى تعاقب كل من كان متكفلا بطفل وطلبه منه من له حق فى طلبه ولم يسلمه اليه تنطبق على حالة الأب الذى لم يسلم ابنه لوالدته بعـد صدور حكم من المحكمة الشرعية يخولها حق حضانته .

SULIMAN SHAFIK EFFENDI. Custody of children — Failure to produce a child — Prosecution of father. (Art. 246 P.C.) Article 246 P.C., which provides that every person who, having the care of a child, fails to produce the same to any person having the right to claim it is punishable, applies to the case where a father fails to hand over his child to its mother to whom the custody of the child has been entrusted by a judgment of the Mehkemeh Sharieh. MINISTÈRE PUBLIC contre SOLIMAN CHAFIK EFFENDI. Garde de l'enfant—Omission de représenter un enfant—Poursuite contre le père. (Art. 246 C.P.) L'article 246 C.P. qui punit celui qui, étant chargé de la garde d'un enfant, ne le représentera pas aux personnes qui auront le droit de le réclamer, s'applique au cas où le père a refusé de livrer son enfant à la mère de celui-ci, alors que la garde de l'enfant avait été confiée à la mère par jugement du Mehkémeh Charieh.
