اخفاء شخص فار من الخدمة العسكرية بعــد تجنيده أو مساعدته على الفرار من وجه القضاء معاقب عليه بموجب المــادة ١٢٧ من قانون العقوبات لا بموجب المــادة ١٢٤ من قانون القرعة فان هــذه المــادة الأخيرة لا تنطبق الا اذا كان الشخص الذى أخفى مطلوبا للتجنيد ولم يدخل الجيش فعلا . ولا عبرة فى هــذه الحالة بعدم امكان محاكمة الفار من الخدمة العسكرية أمام المحاكم الأهلية اذ أن كلمة "القضاء" المنصوص عنها فى المــادة ١٢٧ عقوبات عامة ومن ثم فانها تشمل القضــاء العسكرى الذى هو مختص دون سواه بمحاكمة الفارين من تلك الخدمة .

(Page 161) SUMMARY TRIBUNAL OF GUIRGA. 15 MARCH 1920. MM. Haroun Selim Eff. (J.) : Mahmoud Fouad Eff. (State Rep.). STATE REPRESENTATIVE AHMAD OSMAN AHMAD AND OTHERS. Harbouring a deserter—Elements of offence—Recruiting.—(Art. 127 P.C.—Art. 124, Recruiting Law of Nov. 4, 1902.) The act of harbouring a person who has deserted the army after having been enlisted, or of aiding such person to escape from justice, is punishable under Article 127 P.C. and not under Article 124 of the Recruiting Law. The latter article is applicable only where the person harboured has been called up with a view to enlistment, but has not yet actually entered the army. The fact that the deserter himself cannot be tried by the Native Courts on the charge of the desertion is without importance in this respect, for the term " justice " in Article 127 P.C. is general and may therefore include the military courts, which alone have jurisdiction in this matter.

Recel d'un déserteur de l'armée—Eléments de l'infraction—Recrutement militaire.--(Art. 127 C.P.—Art. 124, Décret du 4 nov. 1902 sur le Recrutement militaire.) Le fait d'avoir recelé, ou d'avoir aidé à se soustraire à l'action de la justice, une personne qui a déserté de l'armée après y avoir été enrôlée, est punissable du chef de l'article 127 C.P. et non de l'article 124 de la Loi sur le recrutement militaire. Ce dernier article ne s'applique que lorsque la personne recelée a été seulement appelée en vue de sone nrôlement, sans toutefois être effectivement entrée dans l'armée. Le fait que le déserteur lui-même ne peut pas être poursuivi du chef de la désertion par-devant les Tribunaux Indigènes est sans importance à cet égard, l'expression "l'action de la justice" dans l'article 127 C.P. étant générale et pouvant, par conséquent, comprendre la justice militaire qui est seule compétente en la matière.
