المبادئ المستخلصة
١ – تنازلت جدة لأحفادها عن عقـارات تملكها واشترطت عليهــم أن لا يتصرفوا فى تلك العقارات بالبيع أو الرهن مادامت على قيد الحياة مع حفظ حقها فى الريع طول هــذه المدة . وقد حكم بأن هذا العــقد يعتبر بيعا لا وصية وعلى ذلك فلا تملك الجدة حق الرجوع فيه (١) . ٢ – فى حال بيع العقار مرتين متواليتين من شخص واحد فليس للمشترى الثانى الذى سجل عقده أن يدفع بعدم تسجيل عقد البيع الصادر للمشترى الأول اذا ثبت أنه كان سيىء النية وأن البيع الثانى الذى صدر له كان نتيجة تواطؤ مع البائع (٢) .

Sale—Legacy—Conditions.—(Art. 235 C.C.—Art. 530, Code of Muhammadan Personal Law.) II. Sale—Successive sales—Transcription—Good faith—(Arts. 270, 611, 615 C.C.) I. A deed by which a grandmother transferred to her grandchildren immovable property belonging to her, with a stipulation that the transferees should not dispose of the property in question as long as their grandmother lived, and that the latter retained the right of enjoyment, must be considered a sale and not a legacy. Such contract not being a legacy, the grandmother could not revoke it. (1) II. When immovable property has been sold successively by the same person to two purchasers, the second purchaser, if he has caused the deed of sale to him to be transcribed, is not entitled to set up default of transcription as against the first, if it be shewn that he acted in bad faith and that the sale to him was of a collusive nature. Doit être considéré comme une vente et non comme un legs, le contrat par lequel une grand'mère a cédé à ses petits-fils des immeubles lui appartenant, avec stipulation que les acquéreurs ne disposeraient pas des dits immeubles du vivant de leur grand'mère, qui en conservait la jouissance. Cet acte n'étant pas un legs, il s'ensuit que la grand'mère ne peut pas le révoquer. (1) II.
