١ — لا يجوز قبول البينة دليلا على وجود شركات المحاصة بل أن مثل هذه الشركات لاتثبت إلا بابراز الدفاتر والمخاطبات الدالة على ذلك حيث ان المادة ٦٣ تجارى قد حصرت طرق الاثبات فى الدليلين المذكورين . ٢ — فى المسائل التجارية لا تكون الدفاتر التجارية حجة على الغير أمام القضاء إلا اذا كانت من الدفاتر القانونية المنظمة فان لم تكن كذلك فيجوز اعتبارها حجة على من قدمها لا له .

Evidence in commercial cases—Commercial books—Probative force.—(Arts. 15 and 17 Com.C.) I. Oral evidence is not admissible as proof of the existence of an association in participation. Such associations may only be evidenced by the production of the books and of the correspondence, Article 63 Com.C. having limited to these two modes the evidence admissible in this matter.(1) II. In commercial matters, commercial books are only admissible at law as evidence when they are regularly kept. Books which are not sufficiently regular may, however, be set up as evidence against their owners and not in support of the claims of such owners.
