ان بلاغ القائد العام للقوات البريطانية فى مصر الصادر فى ١٧ مايو سنة ١٩١٩ لم يقصد به سوى تلافى سقوط الحقوق الذى يحتمل حصوله لعدم استطاعة اتخاذ الاجراءات المانعة من ذلك فى الميعاد القانونى سواء أكانت قضائية أم غير قضائية اذا كان ذلك الميعاد ينتهى فى خلال المدة المشار اليها . وعليه فلا يترتب على ذلك البلاغ امتداد أو ايقاف الأزمنة المحددة لسقوط الحقوق الموضوعية سواء أكانت حقوقا مكسبة للملكية أم مسقطة للتعهدات إلا اذا انتهى أجلها فى خلال تلك المدة .

Civil procedure — Time-limits — Suspension — Political disturbances — (Proclamation of General Officer Commanding-in-Chief the British forces in Egypt, dated May 17, 1919.) The Proclamation of the General Officer Commanding-in-Chief the British forces in Egypt, dated May 17, 1919, had only for object to prevent the forfeiture of rights which might result from the non-performance of a judicial or extrajudicial act within the term prescribed by law, where such term came to an end during the period fixed by the said Proclamation. Consequently, the ordinary terms for extinctive or acquisitive prescription cannot be prorogated or suspended, except where they expired during the period in question.

TRIBUNAL DE MANSOURAH. (Jugement en Appel). 1er Février 1921. MM. Mohamed Hilmy Issa Bey (Prés.); Edward Van Der Moren, Nicola Khalil Eff. (JJ.) MINISTÈRE DES WAKFS contre AHMED AHMED KOTRI. Procédure civile — Délais — Suspension — Troubles politiques—(Proclamation du 17 mai 1919 du Général Commandant en Chef les Forces Britanniques en Egypte). La proclamation du Général Commandant en Chef les Forces Britanniques en Egypte, datée le 17 mai 1919, n'avait d'autre but que d'éviter la déchéance des droits qui pourrait avoir lieu, faute d'exécution d'un acte judiciaire ou extra-judiciaire dans le délai prescrit par la loi, au cas où ce délai prenait fin pendant la période fixée à la dite Proclamation. Par conséquent, il n'y a pas lieu à proroger ou à suspendre les délais ordinaires de la prescription extinctive ou acquisitive, à moins que ces délais n'expirent au cours de la dite période.
