المبادئ المستخلصة
يجب على من يتعاقد مع الغير أن يتحرى ويبحث عن أهلية من تعاقد معه حتى يتأكد من صحة التعاقد وإلا فعليه أن يتحمل نتيجة تقصيره وإهماله . وقد حكم بأنه لا يجوز لمن اشترى عقارا من شخص قرر المجلس الحسبى باستمرار الوصاية عليه بعد بلوغه سن الثمانى عشرة سنة أن يتمسك بصحة عقد البيع ارتكانا على أن ذلك القرار لم ينشر بالجريدة الرسمية بل أن مثل هذا العقد يكون قابلا للبطلان عند طلب عديم الأهلية . أنظر استئناف ١٢ يونيه سنة ١٩١٦ (المجموعة الرسمية السنة الثامنة عشرة عدد ٩ ) وعكس ذلك أحكام المحاكم المختلطة المبينة بالحاشية .

COURT OF APPEAL. 15 February 1921. MM. Ahmad Talaat Pasha (Pres.); Clapcott, Ahmad Zaky Aboul Seoud Bey (JJ.). DAME NABAWIA BENT HASSAN EL KASSABY v. DAME SUSAN MORKOS. Sale — Capacity — Decision maintaining guardianship — Omission to publish the decision — Effect — (Art. 19, Ministerial order of January 26, 1897.) A person who enters into a contract with another should take care to find out whether the latter has capacity to contract or not, and he must suffer the consequences of his own negligence in this respect. Held, that a person who has purchased an immovable from a person under incapacity whom the Meglis Hasby has decided to maintain under guardianship beyond the age of 18 years, cannot invoke the omission to publish this decision in the "Official Journal" in order to uphold the validity of the sale. The contract remains voidable at the instance of the incapable person. Cf. App., June 12, 1916 (O.B. XVIII, No. 9); and see, contra, the judgments of the Mixed Courts cited in the foot-note.

Vente — Capacité — Décision prononçant le maintien de la tutelle — Omission de publication — Effet.—(Art. 19 de l'Arrêté Ministériel du 26 janvier 1897.) Celui qui traite avec un autre doit faire toutes diligences pour connaitre si ce dernier est ou non, capable de contracter, et doit supporter les conséquences de sa propre négligence à cet égard. Jugé, qu'une personne qui a acheté un immeuble à un incapable, sur lequel le Meglis Hasby a décidé de maintenir la tutelle après l'âge de 18 ans, ne saurait se prévaloir du défaut de publication au "Journal Officiel" de cette décision pour soutenir la validité de la vente.
