المبادئ المستخلصة
(١) انه وان كانت المادة ٥١ من قانون تشكيل محاكم الجنايات قد أوجبت على هذه المحاكم النطق بالحكم فى الجلسة نفسها أو التى تليها على الأكثر إلا أن هذا النص لا يتناول الأحكام الصادرة بعقوبة الاعدام فليس هناك مدة معينة للنطق بها . (٢) ليس من الأوجه الموجبة لنقض الحكم أن تأخذ المحكمة بشهادة شهود لم تسمعهم اذا دارت المناقشة والدفاع على شهادتهم دون أن يتمسك المتهم بحقه فى سماعهم . راجع نقض ٢٧ ديسمبر سنة ١٩١٩ (المجموعة الرسمية السنة الحادية والعشرين عدد ٥٣) والاحكام المذكورة فى الحاشية .

ALY AHMAD AHMAD SOLIMAN v. STATE REPRESENTATIVE. I. Cassation—Substantial nullity—Pronouncement of judgment—Sentence of death—(Arts. 49 and 51 of Law No. 4 of 1905 instituting Assize Courts.) II. Cassation—Substantial nullity—Witnesses—Hearing of—(Art. 46 of Law No. 4 of 1905 instituting Assize Courts.) I. Under Article 51 of Law No. 4 of 1905, the Assize Courts must pronounce their judgments at the same sitting, or at the latest at the following sitting. This disposition, however, does not extend to sentences of death, in which case no time-limit is fixed for the pronouncement of the judgment. (1) II. The fact that the Assize Court has taken into consideration the evidence of witnesses who have not been heard at the sitting, does not afford ground for cassation, if it is established that this evidence has been discussed and examined by the defence without any reservation.
