اذا ارتكب عدة أشخاص جريمة السرقة واستعمل بعضهم الاكراه فأثر هذا الظرف المشدد يتناول جميع المتهمين بغير استثناء ما دامت السرقة وقعت بناء على اتفاق سابق وكان استعمال الاكراه متوقعا لسبب من الأسباب . أنظر نقض ٦ أكتوبر سنة ١٩١٧ ( المجموعة الرسمية السنة الثامنة عشرة عدد ١١٢ ) .

COURT OF CASSATION. 26 APRIL 1921. MM. Ahmad Talaat Pasha (Pres.); Percival, Marshall, Caloyanni, Hafez Abdel Naby Bey (JJ.): Aly Salem Bey (State Rep.). ALY MUHAMMAD GHURAB AND OTHERS v. STATE REPRESENTATIVE AND ANOTHER. Theft—Aggravating circumstance—Violence — Theft committed by several persons—Use of violence by some of the thieves—Effect as regards the others.—(Arts. 270, 271, 39 P.C.) When a theft has been committed by several persons and some of them have used violence, the effect of such aggravating circumstance extends to all the thieves without distinction, so long as there was previous agreement between them concerning the theft and the eventual use of violence for any reason whatever could be anticipated. Vol—Circonstance aggravante—Violence—Vol commis par plusieurs personnes—Emploi de violence par quelques-uns des voleurs—Effet à l'égard des autres.—Art. 270, 271, 39 C.P.) Lorsqu'un vol a été commis par plusieurs personnes et que quelques-unes ont usé de violences, l'effet de cette circonstance aggravante s'étend à tous les coupables sans distinction du moment qu'il y avait entre eux un accord préalable sur le vol, et qu'on pouvait prévoir l'emploi éventuel de violences pour une cause quelconque.
