الأخبار بأمر كاذب فعل واحد لا يقبل التجزئة حتى ولو تعدد الأشخاص المبلغ فى حقهم . وقد قضى بأنه اذا حكم نهائيا بتبرئة شخص من تهمة البلاغ الكاذب ورفض الدعوى المدنية المرفوعة من بعض من بلغ فى حقهم فلا يجوز رفع الدعوى مباشرة أمام محكمة الجنح من المبلغ ضدهم الآخرين والمطالبة بتعويض مدنى وتكون دعواهم غير مقبولة لأن الدعوى الجنائية قضى فيها نهائيا بحكم حاز قوة الشىء المحكوم فيه ولا يجوز لمحكمة الجنح أن تنظر فى الدعوى المدنية الا من طريق التبعية للدعوى العمومية وهى غير قائمة .

ANTOINE KENIDER AND ANOTHER v. STATE REPRESENTATIVE AND ANOTHER. False information—Plurality of persons against whom the information is laid—Indivisible offence—Effect—"Res Judicata"—Civil claim introduced incidentally to public action.—(Art.264 P.C.—Art. 172 C.Cr.Pr.) The laying of a false information is an indivisible offence, even in the case of plurality of the persons against whom the information is laid. Held, that where a judgment has been rendered in last resort acquitting the informant and dismissing the claim for damages brought by one of the persons against whom the information was laid, a new civil action introduced by another of the said persons, by way of direct summons before the correctional tribunal, against the same informant and in respect of the same information, is inadmissible on the ground that the correctional tribunal can only entertain the civil claim incidentally to the public action, and that the force of res judicata acquired by the first judgment of acquittal constitutes an obstacle to the re-hearing of the public action.

Dénonciation calomnieuse—Pluralité des personnes dénoncées.—Délit indivisible—Effet—Autorité de la chose jugée—Action civile intentée accessoirement à l'action publique.—(Art. 264 C.P.—Art. 172 C.I.Cr.) La dénonciation calomnieuse est un délit indivisible, même en cas de pluralité des personnes dénoncées. Jugé, que lorsqu'il y a un jugement en dernier ressort acquittant le dénonciateur et rejetant la demande en dommages-intérêts introduite par l'une des personnes dénoncées, une nouvelle action civile intentée par une autre des personnes dénoncées, par voie de citation directe devant le tribunal correctionnel, contre le même dénonciateur et du chef du même fait de dénonciation, est irrecevable pour le motif que le tribunal correctionnel ne peut connaître de l'action civile qu'accessoirement à l'action publique, et que l'autorité de la chose jugée acquise par le premier jugement d'acquittement s'oppose à ce que l'action publique soit ré-entendue.
