المبادئ المستخلصة
١ — فى حالة الحجر لعته يجوز ابطال التصرفات السابقة لصدور قرار الحجر اذا ثبت أن العته كان ظاهرا وقت التعاقد (١) . ٢ — اذا ظهر فساد السبب الذى ادعاه الدائن فعليه أن يثبت وجود سبب مشروع للتعهد فاذا عجز الدائن عن ذلك وجب الحكم بطلان التعهد باعتبار أنه غير مبنى على سبب مشروع (٢) . Interdiction—Idiocy—Effect of interdiction on previous dispositions.—(Art. 128 C.C.) II. Obligation—Cause—Falsity of the cause alleged by creditor—Effect.—(Art. 94 C.C.) I. In the case of interdiction on the ground of idiocy, dispositions of propety made by the idiot previously to the decision of interdiction may be declared null and void, if his idiocy was apparent at the time when he made the dispositions in question. Where the cause of an obligation, as alleged by the creditor, is shown to be false, the burden of proving the existence of another lawful cause lies on the said creditor ; failing which, the obligation must be declared null and void, as being without lawful cause. En cas d'interdiction pour cause d'imbécillité, les dispositions faites par l'imbécile antérieurement à la décision d'interdiction peuvent être déclarées nulles si son état d'imbécillité était manifeste au moment où il a fait les dispositions en question.
