المبادئ المستخلصة
لا يكون الاكراه ظرفا مشددا للسرقة بل يكون جريمة مستقلة اذا حصل من السارق بعد تمام السرقة وبقصد التمكن من الهرب (٢) فمن ثم اذا ارتكب شخص سرقة فى منزل مسكون وفى أثناء ركونه الى الهرب وقع منه تعد على شخص هم بضبطه فى بستان منزل مجاور فان الفعل فى هذه الحالة لا يعد سرقة باكراه (١) هذا الحكم مؤيد للحكم المندرج بعده الصادر من محكمة مصر الابتدائية بتاريخ ٩ نوفبر ١٨٩٨ ولاسبابه (٢) من مقارنة هذا الحكم بالحكم الصادر من محكمة الاستئناف بتاريخ ١٦ يونيه ١٨٩٤ ومندرج فى جريدة القضاء سنة ثالثة صحيفة ٣٨٢ يستفاد ان الاكراه يكون ظرفا مشددا للسرقة اذا تلاها فى الحال غير أن هذا المبدأ لا يجوز التوسع فيه وتطبيقه فى حالة ما اذا كان الاكراه وقع من السارق للتمكن من الهرب فى ظروف مماثلة للظروف السابق ذكرها

COURT OF APPEAL(¹) 19 January 1899 MM. Saleh Sabet Pasha (Pres.); Willmore, Ali Zoulficar Bey, Cheikh Muhammad Abdou, Halton (JJ.); Elias Awad Bey (State Rep.). STATE REPRESENTATIVE v. AHMAD EL SAYED (P. C. Art. 287 and follg.). Theft—Aggravating circumstances—Completed offence—Violence. An act of violence committed by the thief after the completion of the theft, and with the sole object of making his escape, does not constitute an aggravating circumstance of theft but a distinct offence. (²) So a person who, after committing a theft in one house, in the course of his escape employs violence against someone who tries to arrest him in the garden of a neighbouring house, is not guilty of the crime of theft with violence. (¹) This decision confirms a judgment of the Tribunal of Cairo, 9 November 1898 (MM. Youssef Bey Sidki (Prés.); Mosely, Fouad Bey Greiss (JJ.); Muhammad Effendi Badreddine (State Rep.) reproduced below, the Court of Appeal adopting the motives contained in the latter judgment. (²) If this judgment is compared with a decision of the Court of Appeal dated 16 June 1894 (El Cada III, 382), it will be seen that violence can constitute an aggravating circumstance in the case of theft "if it immediately follows the theft," but that this theory must not be extended to cover a case where violence is employed to ensure escape in circumstances similar to those above set out.

COUR D'APPEL (¹) 19 Janvier 1899. MM. Saleh Sabet Pacha (Prés.); Willmore, Aly Zoulficar Bey, Cheikh Mohamed Abdou, Halton (CC.); Elias Awad Bey (M.P.) MINISTÈRE PUBLIC contre AHMED EL SAYED (C.P. Art. 287 et ss.) Vol — Circonstances aggravantes — Consommation — Violence. La violence ne constitue pas une circonstance aggravante du vol, mais bien une infraction distincte, lorsqu'elle est commise par le voleur après la consommation du vol et dans le seul but de prendre la fuite (²). Ainsi, l'individu qui a commis un vol dans une maison et qui, pendant qu'il prend la fuite, use de violence contre quelqu'un qui essaye de l'arrêter dans le jardin d'une maison voisine, ne se rend pas coupable du crime de vol avec violence. (¹) Cet arrêt confirme, en adoptant les motifs des premiers juges, un jugement du Tribunal du Caire du 9 Novembre 1898 (MM. Youssef Bey Sidki (Prés.); Mosely, Fouad Bey Greiss (JJ.); Mohamed Effendi Badreddine (M.P.) reproduit ci-après. (²) De la combinaison de cette décision avec un arrêt en date du 16 Juin 1894 (El Cada III. 382) il résulte que la violence peut constituer une circonstance aggravante du vol, si elle "suit immédiatement le vol" mais que cette théorie ne doit pas être étendue au cas où les violences sont exercées pour assurer la fuite dans des circonstances semblables à celles visées ci-dessus.
