المبادئ المستخلصة
تختص المحاكم الاهلية بالنظر والحكم فى قضايا المراكشيين والتى تقام بين مراكشى وأحد رعايا الحكومة المحلية (١) وذلك لان المحاكم الاهلية هى المحاكم الاعتيادية فى القطر المصرى ومن ثمت تكون مختصة بالنظر والحكم فى جميع القضايا مهما كان الخصوم فيها ما لم يكونوا تابعين لجهة اختصاص أخرى بمقتضى قوانين أو معاهدات (٢) ولا يمكن القول بان المراكشيين هم خارجون عن اختصاصها بمقتضى أحكام المادة ٩ من لائحة ترتيب المحاكم المختلطة التى جعلت لها حق النظر فى قضايا الاجانب لان المحاكم المختلطة لما كانت حلت محل المحاكم القنصلية فى دائرة حدود الاختصاص الذى كان لها لا يمكن أن يكون القصد من كلمة الاجانب الواردة فى هذه المادة الا الاشخاص الذين لم يكونوا تابعين للمجالس المحلية وقت تشكيل تلك المحاكم وقد كان المراكشيون تابعين لتلك المجالس المحلية ـ يدل على ذلك أيضا ما جاء فى المادة ١٨ من لائحة ترتيب المحاكم المختلطة من ضرورة اخطار القنصل او التابع اليها الاجنبى باليوم والساعة التى سيكون فيها التنفيذ اذ أنه يستدل من ذلك على أنه لم يقصد امتداد اختصاص تلك المحاكم على أمثال المراكشيين ممن لم يكن لهم قناصل فى القطر المصرى (١) راجع الحكم الصادر من محكمة الاستئناف بتاريخ ٢٧ فبرار سنة ١٩٠٠ المندرج فى هذه المجموعة سنة ثانيه صحيفة ٤٣ (٢) أما المحاكم المختلطة فانها تعتبر المراكشيين كالاجانب وتقول باختصاصها بنظر قضاياهم (راجع الاحكام الصادرة من محكمة الاستئناف المختلطة بتواريخ ٥ يونيه سنة ١٨٧٩ (المجموعة الرسمية للمحاكم المختلطة سنة رابعة صحيفة ٣٩٠) و ٧ مايو سنة ١٨٩٠ (مجموعة القوانين والاحكام سنة ثانية صحيفة ١٨) و ١٠ ينار نة ١٩٠٠ مجموعة القوانين والاحكام سنة ثانية عشر صحيفة ٧١)

SUMMARY TRIBUNAL OF MOUSKY 12 DECEMBER 1900. M. Hafez Effendi Loutfi (J). CHEIKH ABDUL MAGHID MUHAMMAD v. SAYED MUHAMMAD EL HELOU (O.D. Art. 15). Native Tribunals—Jurisdiction RATIONE PERSONÆ—Moors. The Native Tribunals have jurisdiction to try cases between Natives and Moors or between Moors alone. The said Tribunals are Courts of general jurisdiction in Egypt. Consequently their competence ratione personæ extends to all persons who are not excluded from this jurisdiction by laws or treaties. (1) The contention that the Moors are excluded from such jurisdiction by Art. 9 of the Statute of Judicial Organisation for Mixed Suits, which gives jurisdiction to the Mixed Courts in cases where "foreigners" are concerned is inadmissible inasmuch as the Mixed Tribunals merely succeeded (within prescribed limits) to a jurisdiction previously exercised by the Consular Courts, it follows that the word "foreigner" in the said article includes only such persons as were not, at the time when the Mixed Tribunals were created, amenable to the jurisdiction of the local Courts (Magalis Mahallieh). The Moors however were amenable to such jurisdiction. That the meaning of the word "foreigner" is to be thus restricted is further shown by the provision, contained in Art. 18 of the said Statute of Judicial Organisation, that, when judgment is given by a Mixed Court against a foreigner, the consular authority must be notified of the day and hour fixed for the execution of such judgment. This enactment proves that it was not contemplated that the jurisdiction of the Mixed Courts should extend to persons, who like the Moors, have never enjoyed consular representation. (1) N.B. According to the decisions of the Mixed Tribunals the Moors are to be considered as "foreigners" and as such are amenable to such Tribunals—see judgments of the Mixed Court of Appeal of 5 June 1879 (R. TRIBUNAL DE JUSTICE SOMMAIRE DU MOUSKY 12 Décembre 1900. M. Hafez Effendi Loutfi (J.) CHEIKH ABDUL MEGHID MOHAMED contre SAYED MOHAMED EL HELOU (Déc. Réorg. Art. 15). Tribunaux Indigènes — Compétence "ratione personæ" — Marocains. Les Tribunaux Indigènes sont compétents pour connaitre des contestations entre indigènes et Marocains ou entre Marocains (1). En effet, les Tribunaux Indigènes sont les Tribunaux de droit commun en Égypte et sont dès lors compétents, ratione personæ, à l'égard de quiconque n'est pas soustrait à leur juridiction par des lois ou des traités (2). On ne pourrait prétendre que les Marocains sont soustraits à cette juridiction en vertu de l'art. 9 du Règlement d'Organisation judiciaire pour les procès mixtes, qui a accordé aux Tribunaux Mixtes la compétence en ce qui concerne les « Etrangers ». Car, de ce que les Tribunaux Mixtes n'ont fait que succéder, dans les limites qui leur sont assignées, aux juridictions consulaires, il s'ensuit que le mot « Etranger », dans le dit article, ne vise que les personnes qui, au moment de l'institution de ces Tribunaux, ne relevaient pas des Tribunaux Locaux (Magalis Mahallieh). Or, les Marocains relevaient de ces Tribunaux. Cette interprétation restrictive du mot « Etranger » se trouve confirmée par le texte de l'art. 18 du Règlement d'organisation judiciaire, qui exige que le Consulat soit avisé du jour et de l'heure de l'exécution d'un jugement rendu par les Tribunaux Mixtes contre un étranger, disposition qui prouve que l'on n'a pas prévu leur compétence à l'égard des personnes qui, comme les Marocains, n'ont jamais relevé d'un consul.
