المبادئ المستخلصة
لا يعد من أوجه البطلان الموجبة لنقض الحكم أولا — اذا كانت ورقة التكليف فى دعوى القذف بطريق النشر فى الجرائد لا تشتمل على ألفاظ القذف متى أحالت تلك الورقة على أعداد الجريدة الواردة فيها عبارات القذف فان المتهم فى هذه الحالة يمكنه أن يقف تمام الوقوف على موضوع التهمة ويستعد لتحضير دفاعه ٢ — اذا لم يرد فى حكم الاستئناف ذكر نصوص المواد الواردة فى الحكم الابتدائى متى كان حكم الاستئناف صادرا بتأييد الحكم الابتدائى وطبق المواد المذكورة ٣ — اذا كان قاضى الموضوع قد فصل فى التعويضات المحكوم بها للمدعى المدنى وقدرها تقديرا ولم يبحث فى وجه ثبوتها من عدمه لان ذلك من حقوقه التى يتصرف فيها كيفما يتراءى له ولا سبيل لمحكمة النقض عليه فى ذلك ٤ — اذا حكم برفض طلب اثبات واقعة القذف المنسوب الى شخص مكلف بجمع مبالغ لصرفها فى عمل خيرى فان هذا التكليف لا يمكن وصفه بوظيفة من الوظائف العمومية (١) ٥ — اذا لم يذكر فى الحكم حصول تلاوة التقرير ( مادة ١٨٤ من قانون تحقيق الجنايات ) والمداولة متى كانت هذه البيانات مذكورة فى محضر الجلسة ٦ — اذا لم يذكر فى الحكم المطعون فيه سوء قصد المحكوم عليه فى تهمة القذف فان لفظة القذف تشمل ضمنا سوء القصد (١) راجع حكم محكمة الاستئناف الصادر فى ٦ مايو سنة ١٨٩٥ (مجلة القضاء سنة ٢ صحيفة ٣١٨) والاحكام الصادرة من محكمة النقض والابرام المندرجة فى مجلة القضاء سنه اولى صحيفة ٩٨ وسنه رابعه صحيفة ١٤٤ و ٢٠٣ و ٢٧٠ و ٣٦٥ و ٣٦٧ وسنه خامسه صحيفة ٢٢ و ٢٤٤ و ٣٣٩ وسنة سادسه صحيفة ٦٥
Summary (English)
COURT OF CASSATION 3 March 1900 MM. Saad Zagloul Bey (Pres.); De Hults, Wilmore, Youssef Chauki Bey, Halton (J.J.); Muhammad Safwat Bey (State Repr.) ELIAS HAMAWI v. STATE REPRESENTATIVE & ANOTHER (C. Cr. Pr. Art. 220) Cassation—Substantial grounds of invalidity. (a) Notice to appear—Obscurity. (b) Appeal—Confirmation of judgment appealed against—Reproduction of articles applied. (c) Prejudice—Damages—Amount. (d) Defamation—Proof—Public Official. (e) Reading of report—Deliberation of Court—Statement in judgment—Official record of the trial. (f) Defamation—Malice—Statement in judgment. It cannot be considered that there is a substantial ground of invalidity, affording a reason for Cassation, in the following cases: (a) When a notice to appear, served on a person charged with the publication in print of defamatory statements, fails to set out such statements, provided that the notice contains so clear a reference to the passages alleged to be defamatory, that the accused could have no doubt as to their identity, and is consequently in a position to prepare his defence. (b) When a decision on appeal, confirming the judgment of the Court below, applies the articles therein set out without itself reproducing their terms at length (1). (c) When there may be ground for alleging that the Court which tried the case assessed in an arbitrary and only approximate manner the damages to be awarded to the civil claimant (partie civile). The judgment of such court on the question of the existence of prejudice and the amount of damages to be awarded is final and cannot be interfered with by the Court of Cassation. (d) When the Court which tried the case refused to admit evidence of the truth of defamatory statements made concerning a person who had been authorised to collect subscriptions for the organisation of a fête for charitable purposes: for such authorisation could not constitute the person in question a public official (2). (e) When a judgment contains no statement that the report of the reporting judge was read and that the Court deliberated before delivering judgment, provided that the observance of these formalities is mentioned in the official record of the trial (feuille d'audience). (f) Where a judgment, by which a person is condemned for defamation, fails to state in express terms that such person acted maliciously, since the presence of malice is implied in the declaration that the offence in question has been committed. Ne constituent pas des nullités substantielles donnant ouverture à cassation : a) Le fait qu'une citation en matière de diffamation par la voie de la presse ne reproduit pas les propos diffamatoires, si, à raison d'un renvoi précis aux passages incriminés, le prévenu n'a pu se méprendre sur les articulations considérées comme diffamatoires, et a pu dès lors préparer sa défense. b) Le fait, par une sentence d'appel confirmant un jugement de 1re instance et appliquant les articles qui y sont insérés, de ne pas reproduire le texte des dits articles (1). c) Le fait que le juge du fond aurait fixé arbitrairement et seulement d'une façon approximative les dommages et intérêts accordés à la partie civile, le juge du fond statuant souverainement et sans contrôle de la Cour de Cassation sur l'existence du préjudice allégué et sur l'étendue des dommages intérêts. d) Le fait de ne pas admettre l'offre de prouver les faits diffamatoires quand ceux-ci sont imputés à une personne autorisée à recueillir de l'argent pour organiser une fête de bienfaisance, semblable autorisation n'étant pas attributive de la qualité de fonctionnaire public (2). e) Le fait par un jugement de ne pas faire mention de la lecture du rapport (C. I. C. art. 184) et de la délibération du tribunal quand ces mentions sont constatées par la feuille d'audience. f) Le fait par le jugement qui condamne pour diffamation, de ne pas constater que le prévenu a agi de mauvaise foi, l'existence de la mauvaise foi se trouvant tacitement affirmée par la constatation même du délit.
