اذا كانت الجــروح الحــادثة من غير عمد بسبب عدم احتياط محدثها أو اهماله غير مميتة فى ذاتهــا لكنها مع ذلك أفضت الى موت المجنى عليــه لاعتلال صحته وقت الاصابة فان من تسبب فيها يعاقب على جريمة القتــل خطأ لا على جريمة الجرح خطأ فقط . STATE REPRESENTATIVE v. DARWISH MUSTAPHA ALY. Involuntary homicide—Involuntary wounds and blows causing death—Criminal liability. (Arts. 202, 208 P.C.). Where wounds inflicted involuntarily through carelessness or neglect, although not fatal in themselves, have nevertheless resulted in the death of the victim, by reason of the bad state of his health at the time when he was wounded, the offender is punishable for involuntary homicide and not only for wounds inflicted involuntarily. MINISTÈRE PUBLIC contre DARWISHE MOUSTAPHA ALY. Homicide involontaire—Coups et blessures involontaires ayant occasionné la mort—Responsabilité pénale de l'auteur. (Art. 202, 208 C.P.) Lorsque des blessures causées involontairement par maladresse ou négligence, quoique non mortelles en elles-mêmes, ont cependant occasionné la mort de la victime, par suite de son état maladif au moment où elle a reçu ces blessures, l'auteur est punissable pour homicide involontaire et non seulement pour blessures involontaires.
