المبادئ المستخلصة
(١) قرارات القومسيون الطبى التى يصدرها وهو مشكل تشكيلا قانونيا فى أمر قدرة الموظفين على تأدية أعمالهم هى قرارات نهائية لا تقبل الطعن إلا اذا كان الموظف هو نفسه الذى طلب احالته على المعاش بسبب المرض وجاء قرار القومسيون مخالفا لطلبه (١) . (٢) لم يسن نظام الاجازات المرضية إلا لفائدة الموظفين الذين يصابون بأمراض قابلة للشفاء فاذا لم يكن هناك شك فى أن المرض الذى أصاب الموظف لا يرجى برؤه جاز للمصلحة أن ترفض منحه اجازة مرضية (٢) . والقومسيون الطبى هو المختص بالفصل نهائيا فيما اذا كان المرض قابلا للشفاء أم لا .

Public servant—Compulsory retirement for ill-health—Decision of the Medical Board. II. Public servant—Right to sick-leave—Incurable disease. (I. Art. 22, Pensions Law of April 15, 1909.—II. Art. 165, Financial Code). I. The decisions of the Medical Board as to the physical fitness for service of public servants are final, provided that the Board is regularly constituted, save where the public servant himself asks to be retired for reasons of health, but the decision of the said Board is unfavourable to him (1). II. The system of sick-leave was only instituted in favour of public servants when suffering from a disease which is capable of being cured. If, therefore, it be certain that the illness is incurable, the Administration may refuse to grant such leave (2). Fonctionnaire public—Mise à la retraite pour cause de maladie—Décision de la Commission Médicale. II. Fonctionnaire public—Droit à un congé de maladie—Maladie incurable. (I. Sauf dans le cas où le fonctionnaire lui-même demande sa mise à la retraite pour cause de maladie et que la décision de la Commission Médicale est défavorable à sa demande, les décisions de la sus-dite Commission, relativement à l'aptitude physique des fonctionnaires à continuer leur service, sont sans recours si la Commission était régulièrement composée (1). II. Le système des congés de maladie n'a été institué qu'en faveur des fonctionnaires atteints de maladies susceptibles de guérison. S'il est donc certain que le mal est incurable, l'Administration peut refuser l'octroi d'un pareil congé (2).
