لايشـــترط لايقاف دعوى الزنا بنـــاء على تنازل الزوج عن شكواه أن يرضى بمعاشرة زوجته له كما كانت بل يجب ايقافها متى تنازل عنها ولو صرح بعزمه على طلاق زوجته .

SUMMARY TRIBUNAL OF PORT SAID. 9 JULY 1917. MM. Muhammad Said El Ezaby Effendi (J.); Ahmad El Sawy Effendi (State Rep.). STATE REPRESENTATIVE v. KHADIGA BENT ABDOU EL SHARQAWY. Adultery (wife's)—Withdrawal of complaint by husband—Termination of the proceedings. (Art. 236 P.C.) In order that the withdrawal by a husband of the complaint of adultery lodged by him against his wife may have the effect of terminating the prosecution, it is not necessary that he should consent to take her back again. The proceedings must be stopped when he has withdrawn his complaint, although he may have declared his intention to divorce her. See, GARÇON. Code Pénal Annoté. Art. 336-337, Nos. 74 and 75.

MINISTÈRE PUBLIC contre KHADIGA BENT ABDOU EL CHARKAWI Adultère de la femme—Désistement du mari—Arrêt de la poursuite. (Art. 236 C.P.) Le désistement du mari, pour mettre fin à la poursuite pour adultère, n'est pas subordonné à la condition qu'il consente à reprendre sa femme. La poursuite doit être arrêtée lorsqu'il s'est désisté de sa plainte, alors même qu'il aurait manifesté l'intention de la répudier. Voir, GARÇON. Code Pénal Annoté, Art. 336, 337, n°s 74 et 75.
