اتهم موظف عمومى بتبديد أموال أميرية (مادة ٩٧ عقوبات) وبالتزوير فى أوراق عمومية (مادة ١٧٩ عقوبات) بقصد اخفاء التبديد . فحكمت عليه المحكمة بعقوبة التزوير لأنها أشدّ العقوبتين (المادة ٣٢ عقوبات) . وحكمت محكمة النقض والابرام أن عدم الحكم على المتهم بعقوبتى الغرامة والرد التبعيتين اللتين يقضى القانون بالحكم بهما فى جريمة التبديد لا يعدّ خطأ فى التطبيق . أنظر نقض ١٩ أبريل سنة ١٩١٣ (المجموعة الرسمية السنة الرابعة عشرة عدد ١١٢) .

COURT OF CASSATION. 10 NOVEMBER 1917. MM. Yahia Ibrahim Pasha (Pres.); Ahmad Mussa Pasha, Soudan, Abdel Rahman Rida Bey, Hussein Darwish Bey (JJ.); Rizkalla Simaika Bey (State Rep.). AMIN EFFENDI RIFAAT AND OTHERS v. STATE REPRESENTATIVE. Penalties—Misappropriation of public funds—Forgery of public documents—Connexity—Subsidiary penalties. (Arts. 97, 179, 32 P.C.—Art. 229 C.Cr.Pr.) A public servant, on being convicted of misappropriation of public funds (Art. 97 P.C.) and of forgery of public documents (Art. 179 P.C.) committed with a view to dissimulating the misappropriation, was sentenced to the penalty for forgery, as being the heavier punishment (Art. 32 P.C.) Held by the Court of Cassation that the fact that the prisoner was not ordered to pay fine and to restore the money acquired by him, (which are two subsidiary penalties imposed by the law in the case of misappropriation) did not constitute a misapplication of the law. AMIN EFFENDI RIFAAT ET AUTRES contre MINISTÈRE PUBLIC. Peines—Détournement de deniers publics—Faux en écriture publique—Connexité—Peines accessoires. (Art. 97, 179, 32 C.P.—Art. 229 C.I.C.) Un fonctionnaire public, convaincu de détournement de deniers publics (Art. 97 C.P.) et de faux en écriture publique (Art. 179 C.P.), commis afin de dissimuler le détournement, fut condamné à la peine du faux comme étant la peine la plus forte (Art. 32 C.P.) Jugé, par la Cour de Cassation, qu'il n'y a pas fausse application de la loi du fait que le prévenu n'a pas été condamné à l'amende et à la restitution, peines accessoires qu'impose la loi en cas de détournement.
