المبادئ المستخلصة
الاحكام النهائية الفاصلة في موضوع القضية الصادرة من ثاني درجة من المحاكم الابتدائية في مواد الجنح أو من محكمة الاستئناف في مواد الجنايات والجنح هي التي يجوز الطعن فيها دون غيرها أمام محكمة النقض والابرام أما ماعداها من الاحكام فلا يجوز رفعها أمام محكمة النقض الا مع الحكم في أصل الدعوى فكل طعن يحصل على حكم من هذا القبيل قبل الحكم في أصل الدعوى سابق أوانه ويجب رفضه فيدخل تحت هذا النوع الاخير حكم محكمة الاستئناف القاضي برفض الدفع ببطلان الاجراآت بناء على ان الدائرة التي أمرت برفع الدعوى العمومية لم تكن مشكلة تشكيلا قانونيا (١) (١) هذا الحكم يقرر مبدأ مخالفا للمبدا الذي جرت عليه محكمة النقض والابرام في فرنسا لان هذه المحكمة حكمت بجواز نقض الاحكام التمهيدية والاحكام التي تصدر في مسئلة الاختصاص متى كانت هذه الاحكام صادرة من ثاني درجة وذلك بالتطبيق لنص المادة ٤١٦ من قانون تحقيق الجنايات الفرنساوي الذي أغفله القانون المصري أما القضاء المصري كما يستفاد من نص هذا الحكم فانه لم يجز الطعن الا من الاحكام الفاصلة في أصل الدعوى أيا كان نوعها وقد جاء في كتاب المسيو دوهلس المستشار بمحكمة الاستئناف الاهلية بحث تفصيلي عن هذه المسئلة في باب النقض والابرام في المواد الجنائية فوجه ١٤ وما يليه وفي وجه ٢٥ وفي حاشية هذا الكتاب صحيفة ٢٨١
Summary (English)
COURT OF CASSATION (¹) 13 JANUARY 1900. AKLE BEY GHEITH v. STATE REPRESENTATIVE (C. Cr. Pr. Art. 220). Cassation—Judgment on the merits—Other judgments. The only judgments, which can be made the object of a separate application for cassation, are those which terminate the criminal proceedings. A judgment of any other kind can only be brought before the Court of Cassation simultaneously with the judgment on the merits; any application to the said Court made prior to such last mentioned judgment is premature and cannot be entertained. When, therefore, a Court of Appeal, in the exercise of its right of evocation, has ordered the institution of criminal proceedings, and objection is taken to the validity of such proceedings on the ground that the said Court was not duly constituted, the judgment of the Court of Appeal, dismissing such objection, is not open to separate review by the Court of Cassation. (¹) Note.—This judgment affirms an important difference between the jurisprudence of the Egyptian Native Court of Cassation and that of France. The latter, in virtue of the construction placed upon the terms (not reproduced in the Egyptian Native Codes) of Art. 416 of the French Code of Criminal Procedure, allows a separate application for cassation in respect of all interlocutory decisions of a Court of last resort prejudging the merits, as also of all decisions of such a Court on the question of jurisdiction. The jurisprudence of the Egyptian Native Court of Cassation, as enunciated in the decision summarised above, only allows a separate application for cassation in the case of judgments, whatever their character, which terminate the legal proceedings. COUR DE CASSATION (¹) 13 JANVIER 1900. AKLE BEY GHEITH contre MINISTÈRE PUBLIC (C. I. C. Art. 220). Cassation — Jugements sur le fond — Autres jugements. Les jugements et arrêts qui mettent fin à la poursuite sont seuls susceptibles séparément de pourvoi en cassation ; tous les autres ne peuvent être portés en cassation que conjointement avec le jugement qui statue sur le fond ; tout pourvoi dirigé contre eux avant ce jugement est prématuré et non recevable. Rentre dans cette dernière catégorie, l'arrêt par lequel la Cour d'Appel rejette une exception de nullité basée sur ce que la procédure d'évocation de l'action publique a été ordonnée par une chambre qui n'était pas régulièrement composée. (¹) Note.— Cet arrêt consacre une importante différence entre la jurisprudence de la Cour de Cassation Indigène en Égypte, et celle de la Cour de Cassation de France. Cette dernière se basant sur les termes de l'art. 416 du Code d'Instruction Criminelle français, qui ne sont pas reproduits par le Code Égyptien, décide qu'il y a ouverture à pourvoi contre toutes les décisions interlocutoires en dernier ressort, de même que contre les décisions en dernier ressort rendues sur la compétence. La Jurisprudence Égyptienne, au contraire, telle qu'elle résulte de l'arrêt analysé ci-dessus, n'admet cette voie de recours que contre les jugements qui mettent fin au procès de quelque nature qu'ils soient.
