المبادئ المستخلصة
لما كان من المبادئ المقررة قانونا ان المعارضة فى الاحكام الغيابيــة متى كان شكلها صحيحا تجعــل الدعوى فى الحالة التى كانت عليها من قبــل فيجب حينئــذ على المحكمة متى رفعت اليها معارضــة فى حكم غيابى ولو تخلف المعارض عن الحضور أن تفحص أوراق الدعوى وأن لاتحكم فى المعارضة الا بعد الاطلاع على أوراق القضــية (مادة ١٥٨ من قانون تحقيق الجنـايات) ولا يجوز للمحكمة فى هذه الحالة أن ترتكن عــلى مجــرد تخلف المعارض عن الحضور وتعتبر هذا التخلف بمثابة عدول من المحكوم عليه عن معارضته أما ما ورد فى المادة ١٨٦ من قانون تحقيــق الجنــايات عن الاحكام الصــادرة من محكمة ثانى درجــة فهو استثناه من هــذه القاعــدة لايتعــدى الاحكام المشار اليها فــلا يجوز التوسع فيه وتطبيقه من باب القياس والمشابهة على الاحكام الابتدائية
Summary (English)
Circular of the Committee of Judicial Surveillance. 11 February 1900. No. 2. (C. Cr. Pr. Arts. 158, 186.) Judgment by default in criminal proceedings—Opposition—Non-appearance of the opposing party—Trial of the merits of the case. It is a general principle that the effect of an opposition duly made is to place the case in statu quo. When, therefore, opposition has been duly made to a criminal judgment of first instance, the Court is bound, even if the opposing party fails to appear, to rehear the case, and to form its decision upon an examination of the documents (C. Cr. Pr. Art. 158). The Court has no power to base its judgment solely upon the failure to appear, treating the same as an abandonment of the opposition. The exception to this rule in the case of judgments of the Court of Appeal (C. Cr. Pr. Art. 186) is confined to such judgments, and is not to be extended by analogy to judgments of first instance.

Circulaire du Comité de Surveillance Judiciaire. 11 Février 1900, N° 2. (C. I. C. Art. 158, 186.) Jugement par défaut en matière pénale — Opposition — Non-comparution de l'opposant — Examen du fond. Il est de principe que l'opposition régulière en la forme remet l'affaire en état. Dès lors, en cas d'opposition régulière en la forme contre un jugement correctionnel en premier ressort, le tribunal doit, même si l'opposant ne comparaît pas, examiner l'affaire à nouveau et ne statuer que sur le vu des pièces (C. I. C. art. 158). Il ne peut se baser exclusivement sur le défaut de comparution, considérant celui-ci comme une renonciation à l'opposition. L'exception à cette règle établie par l'article 186 du C. I. C. pour les arrêts de la Cour d'Appel est limitative et ne peut être étendue par analogie aux jugements rendus en premier ressort.
