أتت المواد ٦٦٨ وما بعدها من قانون المرافعات على بيان الأشخاص الذين يحق لهم اتخاذ الاجراءات التحفظية المقررة فيها وجاء تعدادهم هذا على سبيل الحصر فلا يجوز منح هذا الحق ولو باتفاق صريح بين الطرفين لدائن غير الدائنين المتوفرة فيهم الشروط الواردة فى المواد المذكورة .

SUMMARY TRIBUNAL OF LUXOR. 1 OCTOBER 1914. M. Muhammad-Tewfik Khalil Effendi (J.). AYOUB EFFENDI NACCACHE v. HASSANEIN MOHAMED ABOUL HASSAN AND ANOTHER. Conservatory measures—Persons entitled—Limitation. (C.C.C.Pr. Arts. 668-680.) The list of persons who may have recourse to the conservatory measures set out in Articles 668 and following of the Code of Civil and Commercial Procedure is exclusive. Even where there is an express agreement, no creditors other than those who come within the terms of the above mentioned articles are authorized to make use of these measures.

Mesures conservatoires — Qui peut en faire usage— Enumération limitative. (Art. 668 à 680 C.P.C.C.) L'énumération dans les articles 668 et suivants du Code de Procédure civile et commerciale, des personnes qui peuvent faire usage des mesures conservatoires prévues par ces articles, est strictement limitative. Par conséquent, le droit d'user de ces mesures ne pourrait être attribué, par une convention expresse, à un créancier autre que ceux qui sont dans les conditions requises par les susdits articles.
