المبادئ المستخلصة
المكافأة الشهرية التى تصرفها الحكومة لأعضاء الجمعية التشريعية هى فى حكم ما نص عنه الأمر العالى الصادر فى ٢٦ فبراير سنة ١٨٩٠ الذى يمنع توقيع الحجز على بعض مبالغ وإذن لا يمكن توقيع الحجز عليها لدين خلاف ما هو مطلوب للحكومة كما هو واضح بالأمر العالى المذكور وعليه لا يمكن تثبيت الحجز المطلوب توقيعه تحت يد نظارة المالية على مكافأة أحد الأعضاء لدين تجارى عليه .

M. Ahmed Zaki Serour Bey (J.). ALY BEY LEHEITA AND ANOTHER v. MINISTRY OF FINANCE AND ANOTHER. Legislative Assembly—Allowance of members—Liability to arrestment. (Decree of February 26, 1890.) The monthly allowance paid by the Government to members of the Legislative Assembly comes within the terms of the Decree of February 26, 1890, which exempts certain payments from liability to seizure, and is, therefore, not liable to arrestment for debts due by a member, other than debts due to the Government, as specified in that decree. Consequently, an arrestment of the allowance in the hands of the Ministry of Finance, which was made in respect of a commercial debt due by the member to whom it was payable, was not confirmed by the Court.

TRIBUNAL SOMMAIRE DU MOUSKY. 23 JUIN 1914. M. Ahmed Zaki Serour Bey (J.). ALY BEY LEHEITA ET AUTRE contre MINISTÈRE DES FINANCES ET AUTRE. Assemblée Législative — Indemnité — Saisissabilité. (Décret du 26 fév. 1890.) L'indemnité mensuelle payée par le Gouvernement aux membres de l'Assemblée Législative tombe sous l'application du Décret du 26 février 1890 qui soustrait à la saisie certains payements et par conséquent n'est pas susceptible d'une saisie-arrêt du chef de dettes dues par un membre autres que celles dues au Gouvernement comme le spécifie le décret. Par conséquent, une saisie-arrêt qui avait été pratiquée sur l'indemnité entre les mains du Ministère des Finances pour une dette commerciale due par le membre ne fut pas confirmée par le tribunal.
