قد أباح الخط الهمايونى الصادر بتاريخ ١٨ فبراير سنة ١٨٥٦ المبلغ للحكومة المصرية بتاريخ ٩ شوال سنة ١٣٠٨ — ١٨٩٠ للبطركخانات الموجودة فى الممالك العثمانية حق الفصل فى الأحوال الشخصية بين المسيحيين التابعين لها وعليه يكون الحكم الصادر من البطركخانة المارونية على زوج بتسليم ابنته لوالدتها صحيحا ونافذ المفعول وتصبح الأم «الشخص الذى له الحق فى طلب الطفل» طبقا للمادة ٢٤٦ عقوبات . فاذا امتنع أب عن تسليم ابنته لوالدتها تنفيذا لحكم صادر من البطركخانة المارونية وجب معاملته بالمادة ٢٤٦ عقوبات . استند الحكم على أحكام محكمة الاستئناف المختلطة الرقيمة ١٦ مايو سنة ١٨٩٣ و ٢٢ فبراير سنة ١٩١٢ و ٧ مارس سنة ١٩١٣ . وحكم محكمة مصر الاهلية الرقيم ١٣ يناير سنة ١٩١٣ . أنظر أيضا حكم محكمة النقض والابرام الرقيم ٢٧ يناير سنة ١٩١٢ (المجموعة الرسمية السنة الثالثة عشرة عدد ٣٠) . MM. Ghaly Soliman Bey (J.); Mahmud Bayoumy Effendi (State Rep.). STATE REPRESENTATIVE v. LOUIS BADOUR AND ANOTHER. Personal Status—Powers of Christian Patriarchates—Custody of children—Offence of failure to hand over child. (P.C. Art. 246.) The Hatti Hamayoni (Imperial Ottoman Decree) dated the 18 of February 1856, communicated to the Egyptian Government on the 8 Shawal 1308 A.H. (1890), authorises Christian Patriarchates in the Ottoman Empire to exercise jurisdiction in matters relating to the personal status of their followers, and accordingly, a judgment of the Maronite Patriarchate ordering a husband to hand over his child to its mother is valid and enforceable, and the mother is, by virtue of such judgment, "the person entitled to claim" the child, within the meaning of Article 246 of the Penal Code. A father, therefore, who fails to hand over his child to its mother in pursuance of a judgment of the Maronite Patriarchate is punishable under Article 246 of the Penal Code. Statut personnel — Pouvoirs des patriarcats chrétiens — Garde d'enfants — Enfants non remis à qui de droit. (C.P. art. 246.) Le Hatti Hamayouni (Décret Impérial Ottoman) daté du 18 février 1856 communiqué au Gouvernement Egyptien le 8 Chawal 1308 (1890), autorise les Patriarcats Chrétiens de l'Empire Ottoman à exercer leur juridiction sur les affaires relatives au statut personnel de leurs fidèles et par conséquent, un jugement du Patriarcat Maronite, ordonnant à un mari de remettre son enfant entre les mains de sa mère, est valable et exécutoire, et en vertu d'un jugement pareil la mère est "la personne qui a le droit de réclamer" l'enfant dans le sens de l'article 246 du Code Pénal. Un père, par conséquent, qui est en défaut de remettre l'enfant à sa mère, en exécution d'un jugement du Patriarcat Maronite, relève de l'article 246 du Code Pénal.
