يجوز زوال البطلان الناشئ من اعلان الحكم بسبب عدم ذكر حضور الشاهدين وقت التسليم طبقا لنص المادة ١٣ مرافعات بما أن الغرض من نص المادة ١٣ المذكورة هو ضمان معرفة الدعوى للمعلن اليه فالبطلان الناشئ من عدم ذكر حضور الشهود يزول اذا اعترف المعلن اليه بوصول الاعلان وعليه يبتدئ فى هذه الحالة ميعاد الاستئناف من تاريخ الاعلان ولو كان هذا الاعلان غير قانونى . أنظر حكمى محكمة الاستئناف الرقيمين ٢٨ مايو سنة ١٩١٣ (المجموعة الرسمية السنة الخامسة عشرة عدد ٢٠) و ٤ مارس سنة ١٩١٤ (المجموعة الرسمية السنة الخامسة عشرة عدد ٧٥)
Summary (English)
MM. Ali Saqeb Bey (Pres.); Rafferty, Mahmud Foad Effendi (JJ.). EGYPTIAN GOVERNMENT v. IBRAHIM DAHEN. Appeal—Defective service of judgment—Waiver—Time for Appeal. (C.C.C.Pr. Arts. 11, 13, 22 and 353.) The defect in the service of a judgment resulting from the omission to mention the presence of two witnesses, as required by Article 13 of the Code of Civil and Commercial Procedure, may be waived. As the object of the provision of Article 13 is to assure the effective service of the process upon the party cited, the omission to comply with this provision is waived and the service is deemed to be valid when the party cited acknowledges the receipt of the process. Accordingly, in such case, the time limited for appeal runs from the date of service notwithstanding its irregularity. See App. 28 May 1913 (O.B., XV, N° 20); App. 4 March 1914 (O.B., XV, N° 75).

Appel — Vice dans la signification d'un jugement — Nullité couverte — Délai d'appel. (C.Pr.C. et C. art. 11, 13, 22 et 353.) Le vice qui, dans la signification d'un jugement, résulte de l'omission de mentionner la présence de deux témoins, ainsi que le requiert l'article 13 du C.Pr.C. et C., peut être couvert. Comme le but de la disposition de l'article 13 est de garantir la connaissance du procès à la partie citée, le fait d'omettre une pareille formalité est couvert et la procédure est tenue pour valable quand la partie citée reconnait qu'elle a été touchée par la procédure. Par conséquent, en pareil cas, le délai d'appel court à partir de la date de la signification, nonobstant son irrégularité.
