يجب تفسير أحكام المادتين ٢٥٥ و ٢٥٦ من القانون المدنى طبقا لنصوص الشريعة الاسلامية ومن ثم ينفذ البيع الصادر فى مرض الموت من المالك لغير وارث اذا تجاوزت قيمة المبيع ثلث مال المورث مالم يكن القصد من البيع محاباة المشترى بأكثر من الثلث . أنظر حكم محكمة الاستئناف الرقيم أول ابريل سنة ١٩١٤ (المجموعة الرسمية السنة الثانية عشرة عدد ٩٦)

MM. Hassan Galal Bey (Pres.); Clapcott, Muhammad Shukry Pasha (JJ.). EL SITT AYESHA HANEM KOTBY v. AHMAD EFF. MUHAMMAD EL TALLY AND OTHERS. Last illness—Sale to stranger—Validity. (C.C. Arts. 255 and 256.) The provisions of Articles 255 and 256 of the Civil Code must be interpreted in accordance with Mohammedan Law, and accordingly, a sale made during the last illness of the owner to a person other than one of his heirs, of property which exceeds in value one third of the estate of the vendor at the time of the sale, is not invalid under these Articles unless the purchaser makes a profit by the sale exceeding in amount the value of one third of the estate. See App. 1 April 1911 (O.B., XII, N° 96).

Dernière maladie — Vente à un étranger — Validité. (C.C. art. 255 et 256.) Les dispositions de l'article 255 et 256 du C.C. doivent être interprétées suivant le droit musulman et par conséquent, aux termes de ces articles, une vente faite pendant la dernière maladie du propriétaire à une personne autre que l'un de ses héritiers, d'une propriété qui excède en valeur le tiers des biens du vendeur au moment de la vente, est valable, à moins que la vente n'ait pour effet de permettre à l'acheteur de réaliser un bénéfice de plus du tiers de la valeur des biens de la succession.
