بما أنه ليس فى القـانون نص صريح يمنع الوقف من اكتساب الملكية بمضى المدة الطويلة فعلى ذلك تؤول للوقف ملكية العقار الذى يضع ناظر الوقف عليه يده ويباشر زراعته المدة اللازمة لاكتساب الملكية بمضى المدة الطويلة

COURT OF APPEAL. 10 March 1914. MM. Abdel Aziz Kahil Pasha (Pres.); Dilberoglue, Mina Ibrahim Bey (JJ.). AHMAD EFFENDI SHUKRY v. ALI ASHAAT AND OTHERS. Acquisitive prescription— Wakf— Possession by Nazir. As there is no express provision of law prohibiting acquisitive prescription by Wakfs, a Nazir of Wakf can, by possessing and cultivating land for the prescriptive period, acquire it for the Wakf.

Prescription acquisitive — Wakf — Possession du Nazir. Comme il n'existe pas de texte de loi formel interdisant aux Wakfs d'acquérir par prescription, le Nazir du Wakf peut acquérir au profit du wakf la terre qu'il a possédée et cultivée pendant la période requise pour la prescription.
