المبادئ المستخلصة
التعويض الذى يقضى به على المحكوم عليه عن كل يوم من أيام التأخير فى الوفاء يعتبر مقاصة لا جزاء ومن ثم فلا تجوز المطالبة به الا اذا نشأ ضرر فعلا عن الاستمرار فى تأخير تنفيذ التعهد ولو ان التعهد بقى بغير تنفيذ زمنا بعد التاريخ المحدد لحلول الجزاء . حكم لمستأنف عليهم قبل المستأنفين بالزام هؤلاء بفك الرهن المترتب على عقار المستأنف عليهم فى ميعاد معين والا يلزموا بدفع تعويض عن كل يوم من أيام التأخير . ولما لم يقم المستأنفون بفك الرهن فى الميعاد المعين رفع المستأنف عليهم هذه الدعوى يطالبون فيها بمبلغ التعويض المقضى به عن كل يوم من أيام التأخير . غير أن المستأنفين أثبتوا أنهم حصلوا قبل فوات الميعاد على تعهد كتابى من المرتهن يفيد استعداده لفك الرهن وأن المستأنف عليهم علموا بهذا التعهد وأمكنهم بواسطته أن يبيعوا الأرض لشخص ثالث لم يشتر إلا ارتكانا على هذا التعهد ومحكمة الاستئناف حكمت بأنه ولو أن تعهد الدائن المرتهن بفك الرهن لا يعتبر كفك الرهن نفسه ولا يغنى عنه إلا أنه لا يمكن للمستأنف عليهم أن يطلبوا تنفيذ الحكم القاضى بالتعويض طالما أنه لم يلحقهم أدنى ضرر . COURT OF APPEAL. 24 FEBRUARY 1914. MM. Abdel Aziz Kahil Pasha (Pres.); Dilleroglue, Mina Ibrahim Bey (JJ.). EL SAYED MUSTAPHA EL BABY EL HALABY AND OTHERS. v. EL SHEIKH SAYED MOUSSA SHAREEF EL KUTBY AND OTHERS. Obligation — Cancellation of hypothec — Penalty for non-performance—Prejudice. Damages de die in diem awarded by a judgment as a penalty for the non-performance of an obligation are compensatory and not penal, and cannot therefore be recovered unless actual prejudice has been caused by the continued non-performance of the obligation, even though the obligation has remained unperformed for some time after the date fixed for the commencement of the penalty. The respondents had obtained a judgment against the appellants ordering them to procure the cancellation of a hypothec which affected the respondents' land, and fixing a sum as damages for each day during which the hypothec should remain uncancelled after a certain date. The appellants failed to procure the cancellation on the day named and consequently the respondents, notwithstanding that they had been enabled to effect a sale of the property by means of an undertaking by the hypothecary creditor to cancel the hypothec and had thus suffered no damage by its non-cancellation, sought to recover the penal damages awarded by the judgment. The Court of Appeal held that though the undertaking given by the hypothecary creditor was not equivalent to an actual cancellation, the judgment awarding penal damages could not be enforced as the respondents had sustained no prejudice. Obligation — Radiation d'une hypothèque — Pénalité pour inexécution de l'obligation — Préjudice. Les dommages et intérêts pour chaque jour de retard accordés par un jugement comme une pénalité à raison de l'inexécution d'une obligation sont compensatoires et non pénaux, et par conséquent, ils ne peuvent être recouvrés à moins qu'un préjudice actuel n'ait résulté de l'inexécution continue de l'obligation, même si cette inexécution a perduré pendant un certain temps après la date fixée pour le commencement de la pénalité. Les intimés avaient obtenu un jugement contre les appelants condamnant ceux-ci à la radiation d'une hypothèque qui affectait la terre des intimés et fixant les dommages et intérêts dus pour chaque jour de retard dans la radiation de l'hypothèque après une certaine date. Les appelants avaient négligé d'opérer cette radiation et par conséquent les intimés avaient voulu recouvrer les dommages et intérêts accordés par le jugement bien qu'ils eussent eu l'occasion de vendre la propriété, le créancier hypothécaire s'étant engagé à rayer l'hypothèque, et que de cette manière ils n'eussent subi aucun préjudice par le défaut de cette radiation. La Cour d'Appel a jugé que bien que l'engagement pris par le créancier hypothécaire ne constituât pas l'équivalent d'une radiation actuelle, le jugement qui accordait des dommages et intérêts ne pouvait être exécuté puisque les intimés n'avaient subi aucun préjudice.
