المبادئ المستخلصة
١ — نص المادة ٢٧ مرافعات لا يمنع المتعاقدين من أن يتفقوا على أن يحكم القاضى الجزئى ابتدائيا فيما يقوم بينهم من المنازعات . وفى هذه الحالة يكون حكم القاضى الجزئى فى النزاع المقدم اليه برضاء المتعاقدين والذى يزيد عن العشرة آلاف قرش قابلا للاستئناف ٢ — حكم القاضى الجزئى فى المنازعات التى يرفعها له الخصوم برضائهم واتفاقهم هو حكم قابل للاستئناف ما لم ينص الاتفاق صريحا على خلاف ذلك . وقد بنت المحكمة حكمها على السبب الآتى : طبقا للمادة ١٣٤ مرافعات يجب على الخصوم أنفسهم أن يبدوا الدفع بعدم الاختصاص بالنسبة لقيمة الدعوى قبل ما عداه من أوجه الدفع وقبل ابداء الأقوال أو الطلبات الختامية والا سقط الحق فيه وصارت المحكمة مختصة بنظر الدعوى وكان حكمها قابلا للاستئناف طبقا لقواعد القانون العامة . فينتج عن ذلك أنه اذا كان السكوت عن ابداء الدفع يعطى للمحكمة حق النظر فى الدعوى بصفة ابتدائية لان هذا السكوت يعتبر فى حكم الاتفاق الضمنى فمن باب أولى يكون للاتفاق الصريح هذا المفعول (١) (١) انظر حكم محكمة عابدين الجزئية الرقيم ٧ يناير سنة ١٩١٢ (المجموعة الرسمية السنة الثالثة عشرة عدد ١٢٣) . وانظر عكس ذلك حكم محكمة طنطا الابتدائية الرقيم ٢٢ ابريل سنة ١٩١٢ (المجموعة الرسمية السنة الثالثة عشرة نمرة ١٢١)

TRIBUNAL OF BENI SUEF. Judgment on Appeal. 6 JANUARY 1914. MM. Sayed Bassiouny Effendi (Pres.) : M.H. Rafferty, Mahmud Foad Effendi (JJ.). ALY SHARAWY PASHA v. IBRAHIM LABIB BEY. Jurisdiction of Native Courts (inter se)—Jurisdiction of Summary Tribunals by consent—Right of Appeal. (C.C.C.Pr. Arts. 27 and 134.) I.—The terms of Article 27 of the Code of Civil and Commercial Procedure do not preclude the parties to a contract from agreeing to submit disputes to the decision of the Summary Tribunal as a Court of First Instance, and the Summary Tribunals have jurisdiction to decide, subject to appeal, cases submitted to them by consent. II.—A decision of the Summary Tribunal given in pursuance of an agreement between the parties to submit to its jurisdiction is appealable in the absence of an express provision in the agreement to the contrary. The Court based its decision upon the following reason :— Under the provisions of Article 134 C.C.C.Pr. an exception to the jurisdiction of the Summary Court on the ground of the amount involved cannot be entertained unless raised by the parties themselves before other exceptions and before pleading, so that the omission of the parties to raise the exception would have the effect of rendering the Court competent to pronounce a judgment which would, under the ordinary rule of procedure, be appealable. If, therefore, the omission of the parties, equivalent to a tacit agreement, can give the court jurisdiction as a Court of First Instance, à fortiori an express agreement can have this effect. Cf. Compétence des Tribunaux Indigènes "inter se" — Compétence conventionnelle des Tribunaux Sommaires — Droit d'appel. (C.P.C.C. art. 27 et 134.) I. — Les termes de l'article 27 du Code de Procédure Civile et Commerciale n'empêchent pas les parties de se mettre d'accord pour déférer leur litige à la décision du Tribunal Sommaire comme Tribunal de Première Instance et les Tribunaux Sommaires sont compétents pour rendre une décision susceptible d'appel dans les affaires qui leur sont soumises par l'accord des parties. II. — Une décision du Tribunal Sommaire rendue sur un point que les parties, par suite d'un accord, ont soumis à sa compétence est appelable à défaut d'une clause expresse de cet accord stipulant le contraire. Le Tribunal basa son jugement sur les raisons suivantes: Aux termes de l'article 134 du Code de Procédure Civile et Commerciale l'exception d'incompétence du Tribunal Sommaire à raison du taux, ne peut être soulevée que par les parties elles-mêmes avant toutes autres exceptions et avant plaidoiries, de sorte que si les parties ne soulèvent pas l'exception, cette omission aura pour effet de rendre le Tribunal compétent pour prononcer un jugement qui, suivant les règles ordinaires de la procédure, est appelable. Par conséquent, si l'omission des parties, équivalant à un acquiescement tacite, peut rendre le Tribunal compétent comme Tribunal de Première Instance, a fortiori un accord exprès aura le même effet.
