المبادئ المستخلصة
اذا أعيد الانتخاب واشــترك فيه المرشحون الذين لم ينالوا العدد الأكثر من الاصوات فى الانتخاب الاول فلا يعتبر اشتراكهم ســببا للبطلان الا اذا أثر على نتيجة الانتخاب النهائية . فلذلك اذا ترتب على اشتراك هؤلاء الأخيرين عدم حصول أحد المرشحين ممن لهم الحق فى اعادة انتخابهم على الأغلبية المطلقة فى الانتخاب الثانى كان ذلك سببا فى ابطال الانتخاب (١) أنظر الحكم السابق عدد ٤١

COURT OF APPEAL. 17 JANUARY 1914. MM. Bond (Pres.); Soudan, Muhammad Tewfik Nessim Bey (JJ.); Aly Maher Bey (State Rep.). Dr. ALY HUSSEIN BEY AND OTHERS v. MUHAMMAD ALLAM BEY. Electoral Law—Second ballot—Invalidation—Candidates taking part in second ballot who did not obtain the greatest number of votes in the first—Effect on validity of election. (Law No. 30 of 1913, Art. 40.) An election is invalidated by reason of candidates other than those who had obtained the highest totals of votes at the first ballot taking part in the second ballot if their participation might have affected the final result. Where, therefore, on a second ballot in which candidates not entitled to do so had taken part, none of the candidates who were entitled to take part in it had obtained an absolute majority, the election will be declared invalid. Dr ALY HUSSEIN BEY ET AUTRES contre MOHAMED ALLAM BEY Loi Electorale — Second scrutin — Invalidation — Candidats prenant part au second scrutin qui n'ont pas obtenu le plus grand nombre de voix au premier tour de scrutin — Effet sur la validité de l'élection. (Loi N° 30 de 1913, art. 40.) L'élection sera invalidée par le fait que des candidats autres que ceux qui ont obtenu le plus grand nombre de voix au premier tour de scrutin prennent part au second scrutin si leur participation influe sur le résultat final. Par conséquent, l'élection sera invalidée si, au second tour de scrutin, auquel ont pris part des candidats qui n'en avaient pas le droit, aucun des candidats qui étaient en droit d'y participer n'a obtenu la majorité absolue.
