المبادئ المستخلصة
(١) لا يعاد الانتخاب طبقا للمادة ٤٠ من قانون الانتخاب الا بين المرشحين الذين نالوا العــدد الأكثر من الأصوات أى الذين كانوا أقرب من غيرهم فى عملية الانتخاب الاولى الى الاغلبية المطلقة . فلذلك اذا كانت الاصوات التى نالها كل من المرشحين الاولين تزيد عن الاصوات التى نالها أى مرشح آخر وجب اعادة الانتخاب بين هذين المرشحين فقط . أما اذا نال مرشح أصواتا تزيد عن الاصــوات التى نالها غيره وتلاه مباشرة من المرشحين اثنان فأكثر نالوا عددا متساويا من الاصوات فلا يعاد الانتخاب الا بين هؤلاء والمرشح الاول الذى نال العدد الاكثر من الاصوات (٢) اذا أعيد الانتخاب واشترك فيه المرشحون الذين لم ينالوا العدد الأكثر من الاصوات فى الانتخاب الاول فلا يعتبر اشتراكهم سببا للبطلان الا اذا أثر على نتيجة الانتخاب النهائية . ولا يعتبر هذا الاشــتراك مضرا بنتيجة الانتخاب وبالتالى سببا للبطلان اذا حصل أحد المرشحين ممن لهم الحق فى اعادة انتخابهم على الأغلبية المطلقة فى الانتخاب الثانى بالرغم عن اشتراك المرشحين الآخرين الغير قانونى (١) أنظر الحكم التالى عدد ٤٢

COURT OF APPEAL. 17 JANUARY 1914. MM. Bond (Pres.): Soudan, Muhammad Tewfik Nessim Bey (JJ.); Aly Maher Bey (State Rep.). MAHMOUD IBRAHIM EFFENDI v. HASSAN ALY SEIF EFFENDI. Electoral Law — I. Second ballot when no absolute majority on first—Meaning of "greatest number of votes." II. Second ballot—Invalidation—Candidates taking part in second ballot who did not obtain the greatest number of votes in the first—Effect on validity of election. (Law No. 30 of 1913, Art. 40.) I.—According to the terms of Article 40 of the Electoral Law only those candidates who have obtained the two highest totals of votes at the first ballot are entitled to take part in the second ballot. Where, therefore, each of two candidates has obtained a total number of votes greater than any total obtained by any other candidate, they alone are entitled to take part in the second ballot ; but if two or more candidates have tied in obtaining the second highest total in the first ballot, all those candidates who tied are entitled to take part in the second ballot together with the candidate who obtained the highest total. II.—An election is not necessarily invalid by reason of candidates other than those who had obtained the two highest totals of votes at the first ballot taking part in the second ballot, unless the final result was affected by the competition of such candidates. Where, therefore, on a second ballot in which candidates had taken part who were not entitled to do so, one candidate who was entitled to take part had obtained an absolute majority, the election is not invalidated by reason of the wrongful participation of the candidates, as such participation had in no way affected the final result. Second scrutin lorsque la majorité absolue n'a pas été obtenue au premier tour de scrutin — Signification de " Majorité absolue des voix." II. Second scrutin — Invalidation — Candidats prenant part au second scrutin qui n'ont pas obtenu la majorité absolue au premier tour de scrutin — Effet sur la validité de l'élection. (Loi N° 30 de 1913, art. 40.) I. — Aux termes de l'article 40 de la Loi Electorale les candidats qui ont obtenu le plus grand nombre de voix au premier scrutin peuvent seuls prendre part au second scrutin. Par conséquent, lorsque deux candidats ont obtenu chacun un nombre total de voix plus grand que celui obtenu par tout autre candidat, seuls ils ont le droit de prendre part au second scrutin; mais si au premier scrutin deux candidats ou plus ont obtenu la seconde majorité relative, tous ces candidats participeront au second scrutin avec le candidat qui a obtenu le plus grand nombre de voix. II. — Une élection n'est pas nécessairement invalidée par le fait que des candidats autres que ceux qui ont obtenu les deux plus grands nombres de voix au premier scrutin prennent part au second tour de scrutin, à moins que ces candidatures n'influent sur le résultat final. Par conséquent, si au second scrutin auquel des candidats qui n'en avaient pas le droit ont pris part, un candidat qui pouvait y participer a obtenu la majorité absolue, l'élection n'est pas invalidée par cette participation illégale puisque celle-ci n'a en aucune façon influé sur le résultat final.
