اذا تعهد شخص بعمل يستحيل تحقيقه كان ذلك قرينة على سوء نيته لا يسقطها مجرد ادعائه بأنه كان يعتقد امكان ذلك العمل لأن ادعاء كهذا لايقبله العقل ادعى المتهم أن له دراية بعلم الكيميا وأنه يستخرج بواسطتها الذهب من معادن أخرى وتوصل بهذه الطريقة الى الاستيلاء على مبالغ من المجنى عليهم ليشترى بها الادوات اللازمة لتنفيذ هذا المشروع . ولما رفعت عليه دعوى النصب دفع أمام محكمة الجنح بأنه كان يعتقد بحسن نية امكان ذلك الامر غير أن المحكمة قضت بادانته ومحكمة النقض رفضت الطعن المقدم منه بناء على ماقررته من أن استحالة تحقق هذا المشروع بداهة تعتبر قرينة على سوء نية المتهم لا يسقطها مجرد ادعائه الغير معقول بأنه كان يعتقد نجاح مسعاه

COURT OF CASSATION. 10 JANUARY 1914. MM. Bond (Pres.); Muhammad Mehrez Pasha, Ahmad Moussa Bey, Mina Ibrahim Bey, Soudan (JJ.); Atieh Hosny Bey (State Rep.). MUHAMMAD ABDALLAH EL KADRY. v. STATE REPRESENTATIVE. Obtaining money by false pretences—Impossibility of achieving the "pretended" object—Presumption of fraudulent intention—Reasonableness of belief by accused—Rebuttal of presumption. (P.C. Art. 293.) That a person represents himself as being able to perform a feat which is in fact impossible raises a presumption of fraudulent intention on his part, and this presumption is not rebutted by his allegation that he believed the feat to be possible, such belief being "unreasonable." The accused represented himself to be an alchemist capable of extracting gold from other metals and by means of this representation obtained from certain persons sums of money for the purpose of providing the materials necessary for carrying out the alleged object. Notwithstanding the accused's assertion of his bona fide belief in his ability to extract gold, he was convicted of obtaining money by false pretences. The Court of Cassation rejected a motion for cassation of the judgment holding that the clear impossibility of the feat raised a presumption of fraudulent intention, and that the accused's belief in his ability to perform such a feat was not a reasonable belief and did not, therefore, rebut the presumption raised by law.

MOHAMED ABDALLAH EL KADRI contre MINISTÈRE PUBLIC. Escroquerie — Impossibilité d'accomplir l'entreprise promise — Intention frauduleuse présumée — Croyance raisonnable du prévenu — Renversement de la présomption. (C.P. art. 293.) Lorsqu'une personne se présente comme capable d'accomplir un fait impossible en réalité, il y a présomption d'intention frauduleuse de sa part, et cette présomption n'est pas renversée par son allégation qu'elle croyait le fait possible lorsqu'une telle croyance est déraisonnable. Le prévenu s'était donné comme un alchimiste capable d'extraire de l'or d'autres métaux, et par le moyen de cette prétention, il avait obtenu d'un tiers certaines sommes pour acheter les matières nécessaires à la réalisation de ce qu'il alléguait. Nonobstant l'assertion du prévenu qu'il se croyait de bonne foi capable d'extraire de l'or, il fut condamné pour escroquerie. La Cour de Cassation rejeta le pourvoi en se basant sur ce que, de l'impossibilité complète du fait, résultait une présomption d'intention frauduleuse et que la croyance du prévenu dans sa capacité à réaliser une semblable opération n'était pas raisonnable et ne pouvait, par conséquent, renverser la présomption établie par la loi.
