الدفع بعدم الاختصاص بسبب جنسية المتهم يجوز التمسك به فى أى حالة كانت عليها الدعوى حكمت محكمة الجنح بادانة متهم لم يدفع بعدم اختصاص المحكمة ولكنه حصل بعدئذ على الأدلة المثبتة لجنسيته الأجنبية ثم طعن بعدم الاختصاص أمام محكمة النقض وتلك المحكمة قررت أن الدفع بعدم الاختصاص بسبب الجنسية يجوز التمسك به فى أى حالة كانت عليها الدعوى وبالتالى لأول مرة أمام محكمة النقض وبناء عليه ألغت الحكم المطعون فيه القاضى بادانة المتهم

COURT OF CASSATION. 16 JANUARY 1914. MM. Bond (Pres.); Muhammad Mehrez Pasha, Ahmad Moussa Bey, Mina Ibrahim Bey, Soudan (JJ.); Atieh Hosny Bey (State Rep.). YOUSSEF DOLITIAN v. STATE REPRESENTATIVE. Cassation—Jurisdiction of Native Tribunals—Exception not raised in Summary or Central Court—Admissibility before Court of Cassation. An exception to the jurisdiction of the Native Tribunals on the ground of the nationality of the accused may be raised at any stage of the proceedings. A person who had been convicted of an offence by the Summary Court and by the Central Court on appeal and who had raised no objection to the jurisdiction before these Courts, obtained, after his conviction, the necessary proofs of his nationality, and applied to the Court of Cassation for an order quashing the judgment of conviction on the ground of want of jurisdiction. Held, that the objection to the jurisdiction was admissible at any stage of the proceedings, even for the first time on a motion for cassation, and that the judgment of conviction should be quashed.

COUR DE CASSATION. 10 JANVIER 1914. MM. Bond (Prés.) ; Mohamed Mehrez Pacha, Ahmed Moussa Bey, Mina Ibrahim Bey, Soudan (CC) ; Atieh Hosny Bey (M.P.). YOUSSEF DOLITIAN contre MINISTÈRE PUBLIC. Cassation—Compétence des Tribunaux Indigènes—Exception non soulevée devant le Tribunal Sommaire ou le Tribunal du Centre—Admissibilité devant la Cour de Cassation. Une exception d'incompétence des Tribunaux Indigènes tirée de la nationalité du prévenu peut être soulevée à n'importe quel moment de la procédure. Une personne qui avait été condamnée pour un délit par le Tribunal Sommaire et le Tribunal du Centre en degré d'appel et qui n'avait pas soulevé l'exception d'incompétence devant ces tribunaux obtint les preuves nécessaires de sa nationalité et se pourvut en cassation contre le jugement pour défaut de compétence du tribunal. Jugé que l'exception d'incompétence est admissible à tout moment de la procédure, même si elle est soulevée pour la première fois dans un pourvoi en cassation, et que le jugement de condamnation doit être cassé.
